매디슨의 관점에서 본 정치갈등의 제도화와 유진오의 헌법사상 = 권력구조와 의회구조를 중심으로

국문 초록 (Abstract)

이 논문은 제헌헌법을 기초한 유진오의 헌법사상을 매디슨의 관점에서 분석한 글이다. 특히 유진오가 애초 헌법초안에서 적시했지만 헌법제정과정에서 삭제된 권력구조로서의 내각책임제와 의회구조인 양원제에 관한 그의 생각을 정치 갈등의 제도화란 관점에서 살펴보고 있다. 헌법이란 정치갈등을 제도적으로 해결하는 가장 큰 틀에서의 규범이라고 본 매디슨의 시각을 따라 유진오의 헌법사상을 추적한다. 유진오가 내각책임제를 주장한 이유는 정치갈등의 원인으로서의 사회경제적 불평등이 폭발하는 지점은 정부와 의회간의 갈등에 있으며 내각책임제는 이 같은 갈등을 제도적으로 해결하는 가장 효율적인 정부형태라는 것이다. 또한 양원제는 내각책임제가 하원(민의원) 중심으로 운영되는 것을 보완하고 소수자를 배려함으로써 파벌갈등을 완화시키는 역할을 떠맡는다고 주장한다.

다국어 초록 (Multilingual Abstract)

This article analyzes the constitutional thought of You Jin-oh who drafted the first constitution of Korea in Madisonian view. Especially it examines his ideas on the parliamentary cabinet system as power structure and bicameral system as national assembly structure in view of institutionalization of political conflicts, which had been deleted in process of legislating the first constitution though he specified them in constitutional draft. It pursues his constitutional thought in the light of Madisonian perspective that the constitution is the norm in the biggest framework which solves the political conflicts institutionally. The reason why You Jin-oh insisted on the parliamentary cabinet system is because he believes that the socio-economic inequalities as cause of political feud result from the discord between the government and the national assembly, and the parliamentary cabinet system is the most efficient form of government that resolves such conflicts institutionally. And he also insists that the bicameral system makes up for the parliament cabinet system which revolves around the House and alleviates the factional conflicts by considering the minorities.
