“남자 프로스포츠 선수들의 출산휴가” 법적 제도적 환경 및 도입방안 = Paternity leave for players in professional sports

다국어 초록 (Multilingual Abstract)

The Korean professional baseball league composing ten teams is organized as a single unity and each team is supposed to play 144 games over 6 months. The settlement of paternity leave for players in the Korean professional baseball league needs a society at large understanding and strategic approach towards a player’s human rights and the family value.
Through the paternity leave policy, players can receive the right of choice allowing them to have a significant family time during a childbirth period. At the same time, players can appreciate for being a member of a family and a member of a team. That will help players experience work and family balance. That is why discussion on the paternity leave policy can be explained with our society's desirable transition. By extension, the implementation of the paternity leave policy in the Korean professional baseball league will help our society having a serious problem of the birth rate drop. The paternity leave policy can be used to solve the problem since there is a corporate social responsibility in professional sports. In the current study, the authors are interested in examining the needs of the paternity leave policy settlement in the Korean professional baseball league and the introduction and background of the policy settled down in Major League Baseball. Additionally, the authors would like to provide our suggestions and future directions for the adaptation of the policy in the Korean professional baseball league. In conclusion, by participating in discussions and considerations on important social issues arising in the Korean society, the Korean baseball professional league’s paternity leave policy application can represent the importance of a healthy family model. As a result, Korean citizens will consistently love professional baseball and the Korean professional baseball league will be qualitatively improved.

국문 초록 (Abstract)

한국프로야구는 6개월이 넘는 장기 레이스를 치른다. 2015 시즌의 경우, 총 10개 구단이 3월 말부터 10월 초까지 각각 144경기의 정규리그를 소화했다. 프로야구의 출산휴가제는 장기 레이스 중에서 선수가 겪을 수 있는 배우자의 출산과 관련해 선수들에게 출산전후의 시간을 가족과 보낼 수있는 선택권을 보장하기 위한 제도이다. 이는 선수의 인권을 보장하고, 가정의 가치를 보호하며, 선수 스스로 가정과 일의 균형을 찾을 수 있도록 제도적 장치를 마련하는데 그 취지가 있다. 동시에 해당 구단이 대체선수를 선수명단에 올려 경기를 치를 수 있도록 함으로써 팀의 경기력에 최대한 영향이 없도록 조정하기 위함이다. 출산휴가제는 남성 중심의 대표적 프로스포츠 리그의 변화를 통해 가정과 아버지에 대한 사회적 인식 변화에도 긍정적 영향을 줄 수 있을 것으로 기대된다.
특히 한국사회의 심각한 저출산문제에 대한 사회적 관심을 유발하고 일반근로자에 대한 출산휴가제 필요에 대한 공감대를 형성함으로써 스포츠의 사회적 책임을 실천할 수 있는 구체적 정책이 될것이다. 출산휴가제는 대중의 인기로 성장한 프로야구가 출산과 육아에 대한 사회적 인식 변화를적극적으로 받아들이고, 사회문제에 대한 해법을 제시함으로써 리그와 사회가 함께 발전할 수 있는 선순환 고리의 역할을 할 수 있다. 본 연구에서는 한국프로야구리그의 출산휴가제 필요성과 미국 프로야구리그의 출산휴가제도 도입 및 배경을 알아보고, 출산휴가제 도입 및 정착을 위한 제도적 방안을 구체적으로 다루고자 한다.
