인구위기시대 대응을 위한 국토계획의 법적 과제 = A Study on the legal tasks of national land planning for responding to the population crisis

국문초록

장기간의 저출산ㆍ고령화로 인해 이제는 인구감소가 본격화하고 있다. 인구감소는 우리나라 사회 전반에 심각한 위기를 초래하고 있는데 국토계획도 예외는 아니다. 인구감소는 수도권으로의 인구집중으로 더욱 가속화하고 있다. 국토계획 관련 법령이 오랜 기간 수도권의 인구집중을 완화하기 위해서 많은 제도를 마련하여 왔지만 별다른 성과를 내지 못하고 수도권으로의 인구집중을 가속화시키고 있다. 또한 지역 활성화를 위해 다양한 특구제도를 운영하고 있으며, 지방자치단체들은 도시계획에서 인구위기가 아닌 인구증가를 전제로 하여 현실과 괴리된 도시계획을 추진하고 있다.
이러한 인구위기를 극복하기 위해서는 국토계획 관련 법령 제ㆍ개정에서 관행적으로 등장하는 지역균형발전에 대한 본질적인 논의가 이루어져야 한다. 또한 무분별하게 양산되는 특구제도를 과감하게 정비하여 실질적인 성과를 낼 수 있도록 하여야 한다. 또한 지방자치단체의 과도한 인구추정을 방지하고 균형발전거점 중심으로 개편하여 수도권으로의 인구이동을 감소하는 노력이 이루어져야 한다.
어느 나라도 경험하지 못한 단기간의 인구감소에 직면하고 있는 지금에 있어 제도의 남발보다는 기존의 제도를 정비하고 명확하게 하는 노력이 서둘러 이루어져야 할 것이다.

Abstract

Due to long-term low birth rates and aging, population decline is now in full swing. Population decline is causing a serious crisis throughout our society, and the national land plan is no exception. Population decline is accelerating due to population concentration in the metropolitan area. Although laws related to national land plans have established many systems for a long time to alleviate population concentration in the metropolitan area, they have not achieved significant results and are accelerating population concentration in the metropolitan area. In addition, various special zone systems are being operated to revitalize regions, and local governments are promoting urban plans that are out of touch with reality by presupposing population growth rather than a population crisis in urban plans.
In order to overcome the population crisis era, fundamental discussions on balanced regional development, which is routinely featured in the enactment and revision of laws related to national land plans, must be held. In addition, the special zone systems that are being mass-produced indiscriminately must be boldly reorganized so that they can produce tangible results. In addition, efforts should be made to prevent excessive population estimates by local governments and reduce population movement to the metropolitan area by reorganizing around balanced development bases.
Now that we are facing a short-term population decline that no country has ever experienced, efforts should be made to quickly reorganize and clarify existing systems rather than overuse them.
