국유무체재산 관리 및 진흥을 위한 공법적 과제

국문 초록 (Abstract)

국가자산관리가 점차 중요해지고 있는 가운데 향후 국유재산 관리정책의 중심을 국유지 등 부동산뿐만 아니라 지식재산권 등 무형의 재산 즉, 무체재산 관리를 중심으로 국유재산을 포괄할 수 있는 정책 및 이를 뒷받침 할 수 있는 법률 정비의 필요성이 제기되고 있다. 현대 지식정보사회에 걸맞는 국유재산관리를 위해서는 기존 부동산 관리영역에서 머물던 국유재산체계를 국가의 무체재산 개발과 관리를 위한 정책을 추진할 수 있도록 그 제도적 기반을 개선할 필요가 있다. 그러나 최근 국유의 무체재산, 특히 지식재산의 관리 및 가치화에 대한 관심과 중요성의 증대에도 불구하고, 현행 국유재산관리체계는 미흡하기만 하다. 즉, 국유재산의 관리를 위한 기본법이라 할 수 있는「국유재산법」은 부동산 등 유체물을 전제한 규정에 머무르고 있으며, 지식재산 관리를 위한 총괄·종합 정책의 부재는 물론 전체 지식재산에 대한 신뢰할 수 있는 현황 파악이나 통계조사ㆍ분석 등 기본 데이터조차 없는 실정이다.
이에 본고에서는 국유재산으로서 지식재산의 중요성을 환기하고, 국유지식재산을 관리하고 가치를 극대화하기 위한 제도적 개선방안을 모색하였다. 이를 위해 국유지식재산의 현황 및 관리상 문제점을 지적하고, 비교법적 사례 제시와 함께 바람직한 국유지식재산 관리를 위한 법제 개선방안을 제시하였다.

다국어 초록 (Multilingual Abstract)

The management of state properties becoming more and more important, it's necessary to put it in the appropriate conditions where it can include the intangible properties such as intellectual properties as well as real estates which has been the main focus of this legal regime so far. In other words, it needs to establish a juristic foundation for the new management system so that it can fit to the information-oriented society in order to support the policies about development and administration of these intangible properties.
In spite of its arousing interest and importance the actual legal regime has many a points to modify and adapt for the new necessities. In concrete terms, the stipulations in the State Properties Act which is the organic law for the management of intellectual properties as one of the state properties are prescribed in regard to the material properties such as real estates. It lacks not only a general programme which can direct concerned policies but also even the basic statistics from which we can analyse their present situation.
This article, therefore, has as its object to indicate the importance of intangible properties as one of the state properties and to deduce some solutions for the purpose of maximizing the value of the patents and the copyrights that are state properties. Some important actualities and problems of management about state intellectual state properties are analysed to present an orientation for the revision of the State Properties Act, specially through the measure of comparative research with the example of french 'Agency for Public Intangibles of France.'
