In 2018, the U.S. Immigration and Customs Enforcement (ICE) purchased mobile phone location-tracking services from a data brokerage firm called Venntel and used them to combat drug trafficking. Similarly, the Federal Bureau of Investigation (FBI) identified individuals involved in the January 6, 2021, attack on the U.S. Capitol by employing new investigative technologies such as automated license plate readers, facial recognition tools, and reverse location searches. In South Korea, the law enforcement authorities have increasingly requested and used individuals’ location data from telecommunications service providers under statutes such as the 「Communication Secret Protection Act」.
In 2018, the Constitutional Court of Korea held that the law enforcement authorities’ acquisition of “cell site investigation” and “location tracking data” under 「Communication Secret Protection Act」 did not violate the warrant requirement. However, these procedures raise concerns about the lack of procedural safeguards, as they require only judicial “permission” rather than a full “warrant,” thereby excluding the parties’ right to participate.
In contrast, the U.S. Supreme Court, in Carpenter v. United States (2018), ruled that the acquisition of Cell Site Location Information (CSLI) constitutes a “search” under the Fourth Amendment and therefore requires a warrant supported by probable cause. The Court held that obtaining such information under a lesser standard of “reasonable grounds” violates the Fourth Amendment.
Following Carpenter, U.S. government agencies have faced controversy for purchasing data from commercial brokers such as Venntel in order to circumvent warrant requirements. This practice has sparked debate between those who argue that warrant protections do not apply because the information is lawfully “purchased” from a “commercial vendor,” and those who contend that such purchases still implicate the Fourth Amendment because they infringe upon individuals’ reasonable expectations of privacy.
Although there have been no known cases in South Korea of government agencies purchasing personal cell phone location or log data from private entities for investigative purposes, similar issues could arise in the future. Examining the ongoing debates in the United States therefore provides meaningful insight for us in balancing investigative needs with privacy and constitutional protections.
