통일을 대비한 사회보장법학 연구의 필요성과 방향 - 선행 연구와 시대별 분석을 중심으로 - = A Neccesity of Research on Social Security Legal Studiesfor Unification of Korea - Focusing on Preceding Research Analysis and Chronological Change

A legal system preserves public orders by guarantee peoples’ rights and impose their duties in their own social spheres. Unification of South and North Korea is a complexed process in which two very different societies are likely to intergraft, so a huge of conflicts are assumed to be arisen. To solve these problems, the legal system for unifications should take a role as a stitching fiber by instituting new laws, and in particular social security legal studies for unification of Korea will play a key role because absolute majorities of North Koreans will suffer from the extreme poverty.
However, it is difficult to make an answer what the social security legal studies is and to what extent their domains expand, because the aim of social security legislation is so comprehensive that it can participate in many issues on unification. But it is important to reply on these questions to apply the values and methods of social security acts to the issues on unification, and by establishing their own identity, social security studies are able to come into multi-disciplinary studies for unification. Thereby, we can protect the North Koreans from falling into poverty, not by sympathy, but their fundamental rights that new constitutional law will give a guarantee. The first steps to found the definition and categories of social security legal studies for unification is to research and analyze the preceding materials such as scholar articles, research papers, and doctoral dissertations. Much to our regret, there are few doctoral dissertations, which means we have a very thin layer of pool of researchers who can handle the problems on the social security system unification. With the Korea Institute for National Unification (KINU) as the center, the national research institutes have published a few of research papers on social welfare system for unification, but they described the social welfare system as a subordinate role to the macro-social economic institution. There are large numbers of academic papers, but most of these articles are written by social scientists such as social welfare researcher, not jurists. In 1990s, the research on the institutional unification of social security system was activated, and after 2000s the research has gone into details that studies on social insurance, public assistance, veterans welfare, health system are invigorated.

국문 초록 (Abstract)

법치사회에서 법제도는 사회 구성원이 활동하는 모든 분야에서 권리와 의무를 규정 함으로써 사회를 유지한다. 상호 이질적인 두 사회가 만나는 통일 과정에서 법제도 의 역할 역시 통합 과정에서의 부작용을 최소화하고 동반상승 효과를 극대화하여 새로운 사회를 발전·유지시키는 것이다. 그러나 통일 과정에서 필연적으로 많은 부작용이 발생할 것이고 대표적으로 경제격차에 의한 북한 주민의 빈곤 문제가 예상 된다. 통일을 대비한 사회보장법 연구(통일사회보장법학연구)는 북한 주민들에게 닥칠 통일이라는 새로운 사회적 위험으로부터 인간다운 생활을 유지하게 함으로써 통일이 새로운 행복을 위한 과정임을 확인하게 하여야 한다. 또한 남한 구성원들에 게는 통일 과정의 부작용을 최소화함으로써 진정한 사회통합을 이루게 하는 데 기 여하여야 한다. 그러나 이러한 목표를 가진 통일사회보장법의 내용과 영역이 무엇인가에 대해서는 답하기기 쉽지 않다. 사회적 위험의 종류는 많아져 가고 인간다운 생활의 보장 또한 생존적 영역에서 문화적 영역으로 확대되어갈 뿐만 아니라 무엇보다 통일 과정에서 발생할 무수한 쟁점들이 사회보장법이 지향하는 사회구성원의 복지에 연결되어 있 기 때문이다. 그럼에도 불구하고 통일사회보장법의 개념과 영역을 확정해야 하는 이유는 통일 과 정에서 발생할 많은 문제에서 사회보장법적 방법을 도입할 영역을 분명히 하고 북 한 주민들의 인간다운 생활을 기본권으로서 보장하기 위함이다. 또한 다른 통일 법 제 분야와 융합 연구를 위해서는 자신의 정체성이 무엇인가부터 확립할 필요가 있 다. 이러한 과정의 시작으로 먼저 통일사회보장법의 선행연구를 분석할 필요가 있다. 과거 무엇을 연구하였고 그 결과 현재의 지표는 어디인지를 알아야 한다. 그 선행연 구는 학술논문 등의 형태별로 묶은 다음 다시 주제별로 분류하였다. 그리고 통일이 란 과정이 시대의 정치적·경제적 변화에 따라 많은 영향을 받는 만큼 시대별 경향 또한 연구할 필요가 있다. 그 내용을 간략히 요약하자면 1990년 후반까지는 양 사회 보장제도의 통합론이 총론적 성격으로 논의되었으나 2000년대 중반부터는 앞서의 논의를 바탕으로 북한의 각 사회보장제도의 내용 분석과 우리 제도와의 비교론이 각론으로서 많이 연구되었다.
