『목민심서』에 나타난 다산 정약용의 ‘인시순속(因時順俗)’적 지방재정 운영론

국문 초록 (Abstract)

정약용 당대의 지방재정이 안고 있는 모순은 대동법(大同法)이 가진 제도적 한계에서 비롯된 바 크다. 대동법 이후 지방재정의 모순은 잡역 및 정규조세 수취와 관련된 각종 부가세 징수를 둘러 싸고 촌락사회와의 사이에 나타난 복잡다기한 방납(防納) 행위에 집중되었다. 정약용 또한 결세수취(結稅收取)와 관련하여 나타난 방납행위의 일종인 양호(養戶)와 방결(防結), 그리고 향촌 내 권력구조와 관련된 은결(隱結)·여결(餘結)의 문제를 심각하게 인식했다.
『목민심서』에 나타난 정약용의 기본적인 입장은 ‘당대의 시의에 맞추어 향촌사회에 오랜 기간에 걸쳐 정착된 관행을 최대한 존중하는 것[因時順俗]’으로 지역사회의 동요 없이 지방재정의 운영을 원활히 하는데 맞추어졌다. 여기에 중국고대 문물의 이념적 정당성을 차용하고 국초 이래 18세기 성립된 법전체계, 즉 ‘국제(國制)’를 제도운영론의 중요한 원칙이자 이념형으로 삼고 있었다.
정약용은 은·여결과 방결을 지방차원에서 ‘연결(羨結)’이라는 형태로 운용하여 부세운영에 소요되는 각종 비용은 물론 지방재정에 필요한 크고 작은 비용을 충당하자고 제안했다. 이는 지방차원에서 자체적으로 파악하는 재원의 범위를 넓혀 일종의 완충지대를 설정함으로써 지방재정 운영의 숨통을 틔우고 민의 부담을 공평히 하는 방안이었다.
정약용은 목민관으로서 수령은 모름지기 업무에 대해 정확한 파악, 그리고 향촌사회 내부의 여론 주도층과의 직접적인 소통을 통해 이서(吏胥)들을 견제함으로써 지방재정 운영의 문제점을 개선할 수 있다고 하였다.
이서들이 기존에 누려오던 기득권도 심각한 문제가 아닐 경우 눈감아주거나 일정한 선에서 인정해주는 관용적 태도를 취했다. 행정실무자인 이서조직과 통치의 대상인 촌락사회의 동요없이 지방재정을 보다 합리적이고 효율적으로 운영하기 위한 대책은 무조건적인 원칙론의 적용이 아닌 정약용 특유의 현실감각을 바탕으로 강구해낸 ‘인시순속(因時順俗)’의 방안이었다.

다국어 초록 (Multilingual Abstract)

During Jeong, Yakyong"s time, disorder in the rural finance largely stemmed from the limitation of Daedong Policy. After Daedong Policy, this mayhem is attributed to the plethora of proxy payment pratices involved in commandeering labor force and miscellaneous taxations in the rural communities. Jeong seriously recognized and examined several proxy payment schemes : Yangho, Banggyeol and, especially such evil effects of rural hyerarchy as Eungyeol and Yeogyeol. He emphasized in his Mokminsimseo that longrooted customs in the community should be observed and respected according to the trend so that rural finance should be stabilized without any abrupt turmoil. His idea is based on the righteousness of ancient Chinese culture and the principles of royal system which has emerged and persisted since the establishment of Joseon Dynasty. He suggests diverse proxy payments are converted and developed into a form of "Yeongyeol" in order to appropriate the expenditure for taxation and rural administration. This plan is to relieve the governmental and people"s burden by expanding the source of revenue for setting a buffer zone between tax income and administrative expenditure. Jeong also argued that the head of rural community, the governor, could overcome difficulties in the rural government by understanding every detail of administration, and by dominating subordinate officials communicating with public elites. He also took a generous attitude against officials" vested interest only if it is not seriously problematic. Jeong"s solution for the disorder of rural finance without the resistance of officials and disturbance of community, was not strict principles but his forehandedness based on the actual and practical insights
