한의사의 물리치료사 지도 가능성에 관한 고찰 = A legal study on feasibility to instruct physical therapists by Korean medicine doctors

According the Medical Service Act and the Medical Technicians, Etc. Act, Korean medicine doctors do not have right to instruct physical therapists. In the Supreme Court Decision 2011Ma552 decided on May 29, 2015, the Supreme Court of Korea also Judged that Korean medicine doctors cannot instruct physical therapists. The reasons were as follows: firstly, in the Korean dual health care system, medical practice between Korean medicine and Western medicine is divided and practice of physical therapists is closely associated with Western medical practice. Secondly, to instruct physical therapists, medical persons should learn wide range of relevant Western medicine subjects and the national licensing examination for them should evaluate competences to instruct physical therapists; however, education of Korean medicine doctors does not satisfy these conditions. Thirdly, education of physical therapists also does not cover theories and practice of Korean medicine physical therapy. On the other hand, in everyday clinical practice, Korean medicine doctors utilize Korean medicine physical therapy very often and Korean medicine physical therapy is covered by the National Health Insurance since the effectiveness of it has been proved. In addition, the possibility that it causes serious harm to public health is relatively low compared to other treatment modalities. More importantly, the physical therapy usually takes quite long time, and thus, if only Korean medicine doctors should practice the physical therapy and cannot instruct physical therapists, patients also should bear inconvenience caused by this regulation. Furthermore, though dentists have right to instruct physical therapists by the Medical Technicians, Etc. Act, they do not utilize physical therapy often in real practice, and education of dentists also does not cover all the subjects that the Supreme Court suggested. Thus, this study aims to review feasibility of providing Korean medicine doctors with right to instruct physical therapists within scope of Korean medical practice.
