    본 논문의 목적은 헤겔의 자연법에 대한 견해를 살펴보고 헤겔이 자연법이론을 가졌다면 그것이 어떤 것일지 살펴보는 것이다. 헤겔의 자연법이론은 자연법이론의 역사에서 마지막 단계에 등장한 형태로서 이전에 없던 새로운 관점에서 자연과 인간, 정치공동체의 관계를 이해하게 한다. 헤겔은 그것을 철학적 법이론으로 불렀는데, 사변적 사유를 통해 정신의 본성을 파악하고 또 가족과 시민사회, 국가를 그것의 드러남으로 이해하는 관점이다. 본 논문은 그것을 플라톤에서 보았던 우주론적 실재론에 입각한 법이론과 같은 유형으로 파악하며, 사변철학적이면서 형이상학적인 법이론의 특징을 갖는다고 보았다. 헤겔의 철학적 법이론이 자연을 중심으로 하는 전통적인 자연법이론과 구분되는 특징은 다음과 같다. 첫째, 대개의 자연법이론은 자연에 비추어 인간의 삶과 사회, 정치공동체의 관계를 연결지으려 한다. 그러나 헤겔이 보기에 자연은 진정한 주체인 정신의 피조물이자 외피에 불과하며 참된 원리의 근원은 정신(Geist)이라고 보아야 한다. 둘째, 대개의 자연법이론은 자연 본성이 이성을 통해 인간에게 알려진다고 보았다. 하지만 감각세계를 벗어난 영역을 포괄하여 함께 이해할 수 있다는 어떤 실재론을 전제하지 않으면 자연 본성이 무엇인지 말하기는 어렵다. 헤겔은 우주론적 실재론을 채택하고 있으며, 여기서 정신은 대립물의 통일과 원운동의 방식으로 움직이고 인간은 사변적 사유를 통해 이를 파악할 수 있다고 보았다. 셋째, 우주론적 실재론의 내용과 관련해 헤겔은 플라톤의 견해와 매우 유사한 이해를 가지고 있다. 플라톤에게 데미우르고스를 통해 구현되는 창조의 본질이 자유이고 다양성이고 사랑이고 공동선이었듯이 헤겔에게도 정신이 변증법적 운동을 통해 드러내는 세계도 전혀 다르지 않다. 헤겔이 정신의 드러남을 역사적 과정을 통해 설명하고 근대 세계, 특히 가족과 시민사회, 국가를 이해하는 방식으로 제안한 것은 대단히 창의적인 시도였다.

    This article aims to examine Hegel’s view on natural law and to explore what kind of natural law theory he might have held. Hegel’s theory of natural law represents the final stage in the historical development of natural law theories, offering a novel perspective on the relationship between the individual, society, and the political community. Hegel referred to his theory as a philosophical theory of law—an approach that seeks to understand the nature of Spirit through speculative reasoning, thereby illuminating the structures of family, civil society, and the state. This paper interprets Hegel’s theory as one grounded in cosmological realism, characterized by features of speculative or metaphysical legal philosophy. Hegel’s natural law theory diverges from traditional natural law theories in several key respects: First, conventional natural law theories attempt to relate human life, society, and political communities to nature. However, for Hegel, nature is merely a shadow—a creation of Spirit—and not the true subject. The genuine source of principles must be understood as Spirit itself.
    Second, traditional theories posit that natural essence is revealed to humans through reason. Yet, without presupposing a form of realism that allows for understanding beyond the sensory realm, it is difficult to articulate what natural essence truly is. Hegel adopts a cosmological realism in which Spirit moves through the unity of opposites and the form of circular motion, and humans can grasp this through speculative thought.
    Third, in terms of the content of cosmological realism, Hegel’s understanding closely parallels that of Plato. Just as Plato conceived the essence of creation — manifested through the Demiurge — as freedom, diversity, and the common good, Hegel similarly views the world revealed through Spirit’s creative unfolding in these terms.
    Hegel’s attempt to explain the manifestation of Spirit through historical processes and to propose a framework for understanding the modern world—particularly the family, civil society, and the state—was a highly original endeavor.
