    헌법재판소는 평화적 생존권의 유래를 일본 학계와 일본 하급심 법원의 판결에서 찾고 있다. 그러면서도 일본의 최고재판소는 그 권리성을 부정하고 있다는 점, 일본과 다른 헌법을 가진 우리나라에서는 더더욱 그 근거 조항을 찾기 힘들다는 점, 그리고 평화라는 개념 자체가 추상적인 이념에 불과하기에 이에 대한 구체적 권리를 인정하기는 어렵다는 점을 근거로 평화적 생존권의 기본권적 성격을 부정한다. 그러나 평화적 생존권에 대한 한국의 담론이 일본과 마찬가지 방향으로 향할 필연성이 있을까. 본 연구는 이러한 의문을 바탕으로 헌법재판소가 직접 언급한 일본의 하급심 판결, 그 안에서도 가장 중요하다 할 수 있는 나가누마(長沼) 사건의 전체 과정을 그 역사적 순서에 따라 분석해 보고자 한다. 일본의 평화적 생존권이 일본 고유의 법과 역사적 전개에 따라 형성된 결과물이라면, 이를 우리가 그대로 답습할 이유는 없다. 그럼에도 우리 헌법재판소는 일본의 경우를 직접 인용하면서 평화적 생존권의 범위를 지나치게 협소하게 해석하고 있기에, 향후 우리의 시대적 배경에 맞게 이를 더 확장할 필요가 있을 것이다. 최근의 UN 결의 등을 참조하여 대내적으로 발생한 평화의 파괴 행위에 대해서도 해당 권리를 주장할 수 있도록 구성하는 것이 국민의 기본권보장을 더 충실히 할 수 있는 방안이라 생각하며, 마지막으로 평화적 생존권의 구체적 양태에 대한 하나의 가능성을 제시하며 글을 마치고자 한다.

    The Constitutional Court of Korea traces the origin of the right to live in peace to Japanese academia and lower court rulings. However, it denies recognizing it as a basic constitutional right for several reasons: the Japanese Supreme Court itself has denied the right’s justiciability; Korea, with a different constitutional framework, lacks explicit provisions supporting it; and the concept of “peace” itself is too abstract to establish a concrete, enforceable right. Yet, is it inevitable for Korean discourse on the right to live in peace to follow Japan’s trajectory? The study begins with this question and seeks to analyze, in historical sequence, the full proceedings of the Japanese Naganuma case—the most significant among the lower court rulings referenced by the Constitutional Court. If Japan’s conception of the right to live in peace arose from its unique legal and historical context, there is no necessity for Korea to tread down the same path. Nevertheless, the Korean Constitutional Court continues to adopt an excessively narrow interpretation of the right to live in peace. By referencing recent U.N. resolutions, this study suggests developing a framework in which individuals could also invoke this right in response to domestic acts that undermine peace and stability of the people. Such an approach would better serve the constitutional purpose of guaranteeing fundamental rights.
