외국판결승인의 상호보증- 한,미,일의 판례를 중심으로 - = The Rule of Reciprocity in Recognition of Foreign Country Judgement - about Korean, American and Japanese cases -

다국어 초록 (Multilingual Abstract)

To understand the rule of reciprocity which is one of the important factors of recognition of foreign country judgement we need to know foreign country cases. In Japan after 1983 Supreme Court Case, reciprocity means that the foreign country recognize Japanese judgement under the condition that foreign judgement would not be different in important matters. In the year 1895 United States Supreme Court did not recognize French Court decision because of lack of reciprocity but only accept as prima facie evidence. But in many states that chose Uniform Foreign Money­ Judgments Recognition Act or its up-grade version Uniform Foreign­ Country Money Judgments Recognition Act the doctrine had weakened. In Korea the Supreme Court materially changed its attitude toward reciprocity rules as in Japan and the Civil Procedure Law was amended last year. To promote international trade and cooperation we need to widen the recognition of foreign country judgement in the spirit of comity.
