유비쿼터스 도시에 관한 법적연구

국문 초록 (Abstract)

유비쿼터스 사회의 도래로 인해 우리는 정보통신서비스를 시작으로 다양한 분야의 복합 기술 서비스로 인한 편리함을 누리며 다양한 혜택을 받고 있다.
그중 복합적인 유비쿼터스 기술이 집적된 u-City의 개발과 건설은 그러한 기술 혜택에 종합적인 결실일 것이다.
본문에서 검토한 바와 같이 헌법상 추구하고 있는 공공복지의 증진하고 공공재를 늘리는 역할을 한다. 또한 이러한 공공복리의 확대는 기본권의 보장과 실현에도 2차적 기여를 할 수도 있다. 하지만 이렇게 편리한 유비쿼터스 기술이 헌법상 기본권 등을 침해하거나 침해할 위험성을 높이지 않도록 해야만 한다. 따라서 관련 법적인 연구는 계속 필요할 것이다.
본 문에서 유비쿼터스 사회의 100대 법적 과제를 제시하였고, 우리는 앞으로 이러한 새로운 과제를 어떻게 해결할 것인지 연구를 계속 해야 한다. 유비쿼터스 사회에 필요한 일반법리의 연구도 계속 될 것이다. 그리고 각 개별 분야에서 기존의 법리를 적합하게 확대 적용하는 연구도 계속 될 것이다. 이러한 개별 분야중의 하나가 u-City법 분야이다.
2008년 u-City법의 제정으로 u-City의 건설과 관심은 더 늘어 갔지만, 이를 지속하기 위해서는 u-City법을 건설하는 법에서 관리하고 도시를 편리하게 이용하기위한 법으로의 변화가 필요하다.
앞으로도 u-City에 대한 기술적 발전과 관련 지원법제의 결실로 국민의 편의증진과 공공복지 증진은 계속 되어야 한다. 그러면서도 u-City와 관련된 통합기술의 혜택에 부작용인 프라이버시권 등 인권의 침해 혹은 침해 위험의 증가, u-City건설로 인한 지역사회의 격차 및 도시의 확일화 등의 문제가 발생하지 않도록 u-City법의 시행에 따를 개별 법적 사항을 검토하여 고시 등으로 구체화하여 관련 규범을 정립하여 사회의 공공복지를 증진하게 하는 법적․사회적인 연구를 계속하여야 할 것이다.

다국어 초록 (Multilingual Abstract)

Abstract

There are legal issues in the Study on the Ubiquitous law, (1) What should be an ubiquitous law (2) It is necessary to clarify how a legal problem in each concrete field is to solve it in the ubiquitous society.
Moreover, (1) The legal problem concerning u-City must clarify the relation to the Constitution for a long-term the development of u-City. And (2) whether the u-City law according to a field has embodied an appropriate appearance of the law We have to be examined.
Thus this article will look into the principle of ubiquitous law based on the 100 tasks with respect to a ubiquitous society. Based on such, this article will specifically explore the constitutional relation of the ubiquitous city, and look through the ubiquitous city law, so that the said law can work properly in the construction and management of the ubiquitous city.  
The ubiquitous city law enhances public welfare under the constitution. The law should play its role in providing a better city service and in managing a safer city. In that respect, the current law still leans toward its construction role. The law should be continuously studied so that ubiquitous can be managed, be provided with the safe city service. At the same time, the law relating to the protection of the private information should also be studied as to continuously develop ubiquitous city and provide residents with comfortable space and safe management, and as to create a new city culture within such city.
