타투이스트의 법적 불안정성과 범죄피해 신고: 경찰효과성 인식의 매개효과 = Legal Precariousness and Crime Victimization Reporting: The Mediating Effect of Tattoo Artists' Perceptions of Police Effectiveness

국문 초록 (Abstract)

이 연구는 「문신사법」 통과로 타투이스트가 불법적 직업에서 합법적 직업으로 전환되는 과도기적 시점에서, 타투이스트들의 범죄피해 신고행동을 분석하였다. 그동안 한국사회에서 타투이스트는 제도적 정당성을 부여받지 못했으나, 사회적 인식은 점차 완화되어 왔다. 본 연구는 법적 불안정성(권리박탈, 권리행사 어려움, 법적 취약성)이 범죄피해 신고에 미치는 영향을 검증하고, 경찰효과성 인식이 이를 매개하는지 확인하였다.
분석 결과, 법적 불안정성은 범죄피해 신고의 주요 장애요인으로 작용하였으며, 특히 권리박탈과 권리행사 어려움은 경찰효과성 인식을 매개로 경찰 신고에 간접적 영향을 미치는 것으로 나타났다. 이러한 결과는 법적으로 주변화된 집단이 범죄피해를 경험하더라도 경찰의 효과적 대응에 대한 불신으로 인해 신고를 회피하게 됨을 시사한다. 본 연구는 타투이스트의 범죄피해 신고행동에 관한 최초의 실증연구로서, 법적 지위 변화가 경찰-시민 관계 개선에 미치는 영향을 규명하고, 법적으로 불안정한 직업군에 대한 경찰의 접근방식 전환 필요성을 제시한다는 점에서 의의가 있다.

This study This study examines the crime victimization reporting behavior of tattoo artists during a transitional period in which they are shifting from an illegal to a legal occupation following the passage of the Tattoo Artist Act. While tattoo artists have historically lacked institutional legitimacy in Korean society, social perceptions have gradually become more accepting. This research investigates the impact of legal precariousness (rights deprivation, difficulty exercising rights, and legal vulnerability) on crime victimization reporting and examines whether perceptions of police effectiveness mediate this relationship.
The findings reveal that legal precariousness serves as a significant barrier to crime victimization reporting. Specifically, rights deprivation and difficulty exercising rights indirectly influence police reporting through the mediating role of police effectiveness perceptions. These results suggest that legally marginalized groups, even when experiencing crime victimization, avoid reporting due to distrust in effective police response. As the first empirical study on tattoo artists' crime reporting behavior, this research elucidates how changes in legal status affect police-citizen relations and highlights the need for police to adopt a transformed approach toward occupational groups with legal instability.
