A study on Interim Relief and Administrative Litigation

The administrative case is dominated in jurisdiction of court by the Constitutional Law. Accordingly, the jurisdiction can be applicable to all kinds of the executive. This paper focuses its angle on the interim relief by Administrative Litigation Act regulates only the suspension of provisional disposition as interim relief system. Administrative Litigation Act regulates only the suspension of provisional disposition as interim relief system. The effectiveness of litigation system is mitigated by failing the function as interim relief system. In order to accomplish the aim of interim relief system, the security of effectiveness in the judicial remedy by utilizing interim relief system is emphasized.
