학교폭력 피해자ㆍ가해자의 화해조정 사례연구 = Case study of mediation among victim and perpetrator in school violence

국문 초록 (Abstract)

본 연구의 목적은 학교폭력 피해자와 가해자의 치유적 화해조정을 새롭게 구조화시킨 상담기법으로 진행함으로써 당사자들이 어떻게 사과와 용서를 이루어 내는지의 과정을 알아보고, 또한 구조화시킨 상담기법의 효과를 알아보는데 있다. 연구를 위한 도구로는 서울가정법원에서 재판중인 학교폭력의 세 사례를 활용하였다. 이에 따른 주요 기술로는 상대방에 대해 「민감하게 경청하고 있음을 확인시켜주기」, 「자기표현하기」, 「집중하기」등을 하였으며, 모든 참여자의 「마음 알아주기」 후에 본격적으로 사과와 용서의 과정을 진행하였다. 치유적 화해조정을 진행한 결과 세 사례 모두 화해조정 전 상대방에 대한 불신, 분노, 불편한 감정들이 진정한 사과와 용서를 통해 화해에 이르게 되었고, 자녀들의 사과, 용서의 모습을 지켜본 부모들의 법적 합의는 신속하게 진행되었다. 사후인터뷰에서 피해자, 가해자는 상대방에 대한 부정적인 감정의 해소와 자기감정의 정화를 통해 마음의 편안함을 갖게 되었고, 서로의 관계 또한 화해조정전보다 편한 사이가 되었다고 보고하였다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to inquire the effectiveness of new therapeutic mediation procedure among students involved in school violence using counseling techniques on achieving apology and forgiveness among students and restoring relationship. For this, two trial cases were selected from Seoul Family Court while two cases used assignment papers as a tool and the other case's mediation was done using various inventories and its results. Major techniques such as confirming active listening with sensitivity through appreciating students'emotion, expressing self, concentrating were used and after appreciating every participant's emotions, the procedure progressed deeper into forgiving and apologizing. Through the result of therapeutic mediation, it was possible to achieve congruent reconciliation through apology and forgiveness in all three cases and the settlement went smoothly after students'parents'observe their children's reconciliation. During post interview, both victim and perpetrator were able to achieve inner peach by resolving negative feeling of each other and purifying their own emotion and students also reported that their relationship improved compared to their previous relationship during conciliation.
