LRA기준론 - 미연방대법원의 판례를 중심으로 - = A Study on the Less Restrictive Alternative Test - Focusing on the U.S. Supreme Court Decision -

국문 초록 (Abstract)

표현의 자유는 민주주의사회의 초석으로서 최대한의 보장을 받아야 할 것이기에 미국에서는 언론의 자유에 대해 다른 자유권들에 비해 우월한 지위를 부여하려는 이론들이 논의되고 있다. 표현의 자유가 가지는 이러한 우월적 지위의 보장은 검열제금지로 이루어지고, 또한 표현의 자유의 규제가 합헌인지 여부를 판단함에 있어서 요구되어지는 합헌성 판단기준을 다른 자유권의 규제에 있어서보다 더 엄격하게 설정함으로써 이루어지게 된다.
표현의 자유에 대한 제한에 있어서는 표현의 자유가 다른 자유권들보다 우월한 지위를 가진다는 점을 고려하여 보다 덜 제한적인 선택가능한 수단(less restrictive alternative)를 채택해야한다는 이론이 바로 이 원칙이다.
이 기준은 현실적으로 발생되는 복잡한 여러 문제에 대하여 기계적인 해결기준이 되는 것이 아니고 어디까지나 일반적인 준칙이며 구체적인 사안의 성질이나 권리의 성격의 차이에 따라서 달리 적용할 수 있는 유연성을 가지고 있다.
이 LRA기준과 관련하여 우리나라에서는 주로 기본권 제한의 한계 내지 표현(언론․출판)의 자유규제에 관한 입법의 합헌성 판단기준이란 측면에서 매우 중요시 고찰되고 있는 실정이다.

다국어 초록 (Multilingual Abstract)

Freedom of expression should be guaranteed as the foundation of the democratic society. So in the U.S., theories are being discussed that give superior status relative to other rights of freedom to freedom of speech.
The guarantee of such superiority in representation is made up of prohibition of inspection. Also, it is made by placing stricter restrictions on the constitutionality of the constitutional judgment required to judge whether or not the regulation of freedom of expression is constitutional.
It is the principle that, in terms of freedom of expression, the less restrictive alternative should be adopted considering the freedom of expression has superior status than other freedom rights.
This criterion is not a mechanical solution for complex problem that occur realistically, but it has the flexibility to apply differently depending on the nature of specifics of the matter or difference in the nature of a right.
In relation to this LRA standard, in Korea, It is considered very important in terms of the criterion of determining legislative constitutionality of the constitutional restrictions on freedom of speech or limitations of rights limit.
