한미 FTA 정부조달 분야의 협상결과와 정책적 의미 = Korea－US FTA Government Procurement: Negotiation Results and Policy Implications

국문 초록 (Abstract)

본 글에는 한미FTA 협상에서 합의한 정부조달 부분 협정내용을 설명하고 평가하기로 한다. 그러나 FTA 협상결과를 설명하기 전, 한국과 미국이 WTO GPA 가입국이기 때문에 GPA에서 양 국가가 양허한 시장개방의 범위를 처음 살펴보아야만 FTA에서 추가적으로 무엇을 개방하였는지를 평가할 수 있다. 따라서 본 글의 제II장은 GPA의 내용과 GPA에서 양허한 한국과 미국의 정부조달 시장개방 수준을 살펴본다. 제III장은 한국과 미국이 과거 맺은 FTA를 살펴보고, FTA를 통한 각 국가의 정부조달 시장개방 수준을 살펴본다. 제IV장은 한국과 미국의 통계자료를 살펴보면서 시장개방 수준을 살펴보았는데, 실제 규모를 본다면 한국과 미국의 정부조달 관련 무역은 상당히 미미하다는 점을 볼 수 있다. 제V장은 정부조달 분야에 있어서 한미FTA의 협상결과를 살펴보고 주요 결과들의 의미를 짚어보았다. 먼저 시장개방을 도울 결과로는 중앙정부 하한선의 감소, 정부조달 시장개방 대상에 BOT 계약 포함, 공급업체 자격심사에서 국내실적 요구 금지, 그리고 정부조달 작업반 설치 등을 들 수 있다. 협상결과에서 다소 아쉬운 점은 지방정부에 대한 추가적 개방이 이루어지지 않았다는 점, 국방과 중소기업 보호를 위한 국내업체 특혜조치가 유지되었다는 점을 들 수 있다. 제VI장은 정부조달 분야에 있어서 한미FTA 협상결과의 정책적 함의를 찾아보고자 하였고, 제VII장은 간략한 결론이다.

다국어 초록 (Multilingual Abstract)

This article examines and evaluates the results of the Korea－US FTA (KORUS FTA) negotiations for government procurement. However, in order to evaluate the results of the negotiation, one must first examine the provisions and concessions both countries made in the WTO Government Procurement Agreement (GPA), since both Korea and US are signatories of the GPA. Section II of this article examines the provisions of the GPA and the concessions both countries made within the context of the GPA. Section III examines additional market opening measures Korea and US took in the context of their FTAs. Section IV is an empirical analysis of the size of the government procurement market in both countries, and the degree of import penetration in the government procurement markets of both countries. This section shows that despite market opening measures imposed by the GPA and various FTAs, the actual government procurement related trade (exports and imports) are small for both countries. Section V looks at the results of the KORUS FTA for government procurement. Significant market opening measures in the FTA include the lowering of thresholds for central government procurement; inclusion of BOT contracts in the range of government procurement liable for foreign competition; prohibition on requiring previous awards in the domestic territory in the process of evaluation of suppliers or evaluation of bids; and the establishment of a government procurement working group. Disappointments include the failure to further liberalize the government procurement market for sub－central government and other entities; and the failure to re move national security provisions and exceptions for small business set－asides which acts as trade barriers. Section VI tries to draw some policy implications, and Section VII is a short conclusion.
