공공관리자제도의 문제점과 개선방안에 관한 연구 : 성수전략정비구역과 한남재정비촉진지구를 중심으로 = (A) study on the problems and improvements of public management system : focused on the case of Sung-su redevelopment district & Han-nam redevelopment district

다국어 초록 (Multilingual Abstract)

This research seeks the direction of public manager system for future urban and residential environment refurbishment project by suggesting provincial city’s public manager system methods under refurbishment project analyzation through project sites in Seoul, and deducting implementation problems by public manager system, which is enforced with revision of environment renewal development act. The results of research is as belows.

First, the mediation alternatives should found for reasonable cost of public manager’s service between central and local governments, because of priority controversy from organization operation fund shortage and equity problems in organization fund’s saving rate differency between local governments, except Seoul, which has organization funds for public manager service expense.

Second, public manager’s sphere of business should be restricted to the council organization stage to keep the balance and equity between civil organization business professions and public managers, and the function of adjustments and supervisory organization for current weak city dispute adjustment council should be expanded, based on principles of private–implementation and public–management.

Third, to prevent business gaps and current structural corruption at the beginning of the project, it is necessary to restrict and obligate public management system in the beginning stage, and for following expense problem, expansion of urban residential environmental arrangement fund and government subsides through adoption of similar system like organization plan establishment resident proposal system or fund management should be processed.

Fourth, political level efforts are surely required for basic problem-solving including prevention of irrationality in the stages of urban and residential environment organization project by public management system, project delays by lawsuit after project implement permission, and project delays by lacks of business value.

Fifth, currently construction firms are delaying their businesses due to economic condition and current degeneration of real estates from lack of budget constraint and operation specialists according to the condition different between capital areas and provinces, and polices related to organization projects in capital areas. Therefore organization projects in provices and capital areas should be approached in different way, and time adjustment and policy supplementation are needed for introduction of public manager system.

Seoul public management system need two basic premises to be a right public intervention method of urban refurbishing project. First, it should become binary form of civil dominant and public management (public assisted), resident’s assembly should decide to adopt public management system and proposed by public. Second, chronic corrupt relationship of urban refurbishing project should be prevented, and builders should be participated in the early stage of organization plan establishment as priority negotiation subjects for organization project fund’s legit and natural financing.

This research has limitation of objective analysis about policy effectiveness, because there is no business site that is finished through public management after introduction of public manage system. Also, FGI investigation should be needed for find problems of in depth public manager systems, but residents and public might show different position because the moral survey was implemented in the side of organizers and specialists centrally. However, any future research will be vitalized after this research, because majority of newtown and redevelopment․reconstruction sites will have support and management by public managers. Therefore, this research has meaning in the suggestion of improvement measures for right settlement of public management system as a method to manage urban refurbishing project, through case of Sungsoo strategic organization area, which is demonstration public management system site, Hannam refurbishing promote district, and experts attitude survey.

Finally, more detailed research is necessary in the future for new public manager system, because impractical law revision for system introduction might involve with political problems about lack of reliability from misunderstanding between central and local government.

국문 초록 (Abstract)

본 연구는 도시 및 주거환경정비법의 개정과 함께 시행되고 있는 공공관리자 제도에 의한 정비사업의 진행과정을 서울시의 사업구역을 통해 분석하고 시행상의 문제점을 도출하며, 지방 대도시의 공공관리자 제도의 시행방안을 제안함으로써 향후 도시 및 주거환경 정비 사업을 위한 공공관리자 제도의 발전방향을 모색하였다. 연구의 결론을 정리하면 다음과 같다.

첫째, 공공관리자 용역비용에 관련하여 정비기금이 조성되어 있는 서울시를 제외한 타 지자체의 경우 부족한 정비운용기금으로 인한 기금활용 우선순위 논란, 정비기금 적립율 격차에 따른 지자체간 형평성 문제 및 공공관리자 선정시 용역비산정 기준부재에 따른 공공관리자의 용역비 적정성이 논란이 되고 있으므로 중앙과 지자체간 협의이므로 조정대안이 모색되어야 한다.

둘째, 공공관리자 업무범위를 추진위원회 구성단계까지로 가급적 한정하여 민간 정비사업 전문 관리 업자와의 형평성 및 균형을 유지하되 민간-시행, 공공-관리의 원칙에 입각하여 현재 미약한 도시분쟁 조정위원회의 조정기능 및 관리 감독기구로서의 기능을 확대하여야 한다.

셋째, 사업초기의 업무공백 및 현행 구조적 비리를 방지하기 위해서는 공공관리제도를 초기단계에 한정하여 의무화할 필요성이 있으며, 이를 따르는 비용 문제는 정비계획수립 주민제안제도와 같은 유사제도의 도입 또는 기금관리를 통한 도시주거환경정비기금 확충과 국고 보조 확대, 민간에서 재안하는 대여금 처리 후 대물 또는 대금환수방안을 적극적으로 시행 하여야 한다.

넷째, 공공관리제도에 의한 도시 및 주거환경정비사업의 추진단계에서 발생하는 부조리 방지, 사업시행인가 후 소송으로 인한 사업지연, 사업성 부족으로 인한 사업지연 등 도시재정비사업의 근본적 문제해결을 위한 정책적 차원에서의 노력이 반드시 요구된다.

다섯째, 수도권과 지방의 상황이 상이하여 예산의 수급과 전문 인력이 절대 부족하며 정비사업과 관련된 정책들이 수도권을 위주로 시행되면서 최근 부동산시장의 악화 및 경제사정이 예전과 달라 건설사도 사업을 미루고 있는 실정이다. 따라서 지방과 수도권과의 정비사업은 다른 방식에서 접근해야 하며 지방에 공공관리자 제도가 도입되기 위해서는 시기적인 조정과 정책적 보완이 필요하다.

서울시 공공관리제도가 도시재정비사업의 올바른 공공의 개입 수단이 되기 위해서는 두 가지 기본 전제가 필요하다. 첫째, 민간 주도형과 공공관리형(공공지원형)의 두 가지 사업추진 형태로 이원화되어야 하고,공공관리제도의 도입 여부는 공공이 제안하고 주민이 총회를 통하여 결정되어야 한다. 둘째, 도시재정비사업의 고질적인 유착관계의 고리를 끊고, 정비사업비의 합법적이고 자연스러운 자금조달을 위해서는 시공자를 정비계획 수립단계에서 우선협상대상자로 조기에 사업에 참여시켜야 한다.

본 연구는 공공관리제도 도입 이후 공공관리를 통해 준공까지 완료된 사업장이 없어서 제도 도입의 정책적 효과에 대하여 객관적으로 분석할 수 없다는 한계를 가지고 있다. 또한 심도 깊은 공공관리자제도의 문제점 조사를 위해서는 FGI 조사가 수반되어야하나 정비업자 및 전문가를 중심으로한 의식조사를 중심으로 실시되었기 공공관리제도에 대한 주민과 공공은 본 연구의 결과에 대하여 다른 입장을 보일 수 있다. 다만, 앞으로도 서울시 대다수의 뉴타운 및 재개발․재건축사업장이 공공관리자의 지원과 관리를 받게 될 전망이므로 본 연구의 뒤를 이은 후행 연구가 더욱 활성화될 것이다. 따라서, 본 연구는 공공관리제도 시범지구인 성수전략정비구역의 사례와 한남재정비촉진지구의 사례, 전문가 의식조사를 통하여 공공관리제도가 도시재정비사업을 관리하는 수단으로 올바르게 정착되기 위한 절차 개선 방안을 제시하였다는 데 그 의미가 있다.

끝으로 공공관리자 제도를 처음으로 시행하는 만큼 제도도입을 위한 무리한 법의 개정은 중앙정부와 지자체간의 이해가 충돌하여 정책에 대한 신뢰성의 저하를 가져올 수 있다는 행정상의 문제도 내포하고 있으므로 보다 세부적인 연구가 향후 필요할 것으로 판단된다.
