민간경비산업의 실효적 법개정 사안 = A Study on the Effective Law Revision for Private Security Industry

The private security industry is receiving the attention of the world as a future growth industry. As the need and importance of cooperative public order are increasing, it seems that the area of private security will be widened and diversified in the future. In addition, security science and private security science are being deeply studied.
However, the problems related to private security industry have been indicated continuously in various fields. The academy requests private security industry to propose microscopic, in-depth analysis and study from the aspect of science and industry requests private security industry to propose the study related to profit search and connection between industry and school as private security industry develops. Various mass media indicate the dishonor called 'gang' appearing in the field of labor dispute. In other words, it indicates the problem of 「Private Security Industry Act」 regulating the private security industry. It means that it is necessary to systematize the private security industry of advanced country type and national people request effective private security system.
Therefore, the purpose of this study is to discuss the effective law revision issues like 「Private Security Industry Act」 regulating the private security industry.
For effective law revision, first, it is necessary to use and realize the effective term. First of all, the law name like 「Security Industry Act」 and the names like sheriff and security safety guide should be used according to the revised law name. Second, it is necessary to consolidate related laws. It is necessary to promote the unification of 「Private Security Industry Act」and 「Police Assigned for Special Guard Act」 and search for the method to adopt the guard of 「Housing Act」. Third, it is necessary to amend the context of 「Private Security Industry Act」. It is necessary to enlarge the works of guard as in private investigation industry, search for specialization through qualification adoption and settlement, grant power to guard and modify & reinforce the law practically. Government should reconsider the direction of regulatory policy. Regulatory policy should be reinforced and permission condition should be also reinforced. In order to solve the problems, it is necessary to systematize the mutual cooperation system by organizing the private security consortium among industry, school and government.

국문 초록 (Abstract)

민간경비산업은 미래 성장산업으로 세계적으로 주목받고 있다. 행정적으로도 협력치안의 필요성이 부각되고 그 중요성이 높아지고 있어 앞으로도 민간경비 영역은 더 넓어지고 다양화될 것으로 보인다. 또한 학문적으로도 경호학 및 민간경비학이 심층적으로 연구되어지고 있다.
그러나 다양한 방면에서 경비업관련 문제들이 지속적으로 제기되고 있다. 학계에서는 학문적 측면에서 민간경비 영역의 미시적이고 심층적 분석과 연구를, 업계에서는 민간경비산업의 발전과 아울러 기업의 이윤추구 측면과 산학연계형 연구들을 요구하고 있는 것이다. 또한 각종 매스미디어에서는 노사분규현장 등에서 발생되고 있는 일명 ’용역깡패’라는 오명을 지적하고 있다. 민간경비산업을 규제하고 있는 「경비업법」의 문제점을 제기하고 있는 것이다. 이러한 점은 선진국형 민간경비산업의 제도화가 필요하고, 국민들이 실효성 있는 민간경비제도를 요구하고 있는 것이라 할 수 있다.
따라서 이 연구에서는 민간경비산업을 규제하고 있는 「경비업법」 등에 대한 실효적 법개정 사안을 논의하고자 하는데 연구의 목적을 두고 있다.
실효적 법개정을 위해서 첫째, 실효성 있는 용어의 사용 및 현실화가 필요하다. 최우선적으로는 「(민영)보안산업법」 등과 같이 법제명 수정이 요구되고, 동법에 따라 사용되는 명칭을 보안요원(관), 보안안전지도사 등으로의 개정이 뒤따라야 한다. 둘째, 관련 법률의 통합이 필요하다. 「경비업법」과 「청원경찰법」의 통합을 추진하고, 「주택법」의 직영경비원도 흡수하는 방안을 모색해야 한다. 셋째, 「경비업법」의 내용적 개정이 요구된다. 민간조사업 등과 같은 경비업무의 확대, 공인자격 제도 도입과 정착을 통한 전문화, 경비원에게 권한 부여, 기타 현실에 맞는 법규정의 수정보완이 필요하다. 그리고 정부차원의 규제정책 방향도 재고해야 한다. 규제정책은 강화차원으로 변모되어야 하고, 허가요건도 강화되어야 한다. 이러한 과제들을 해결하기 위해서는 산․학․관 민간경비협의체의 구성을 통해 상호협력시스템을 체계화해야 할 것이다.
