반인권 국가범죄에 주관적 소멸시효 기산점 적용에 대한 이해-헌법재판소 결정(2014헌바148)을 바탕으로- = Understanding the Application of the Subjective Extinctive Prescription to the Anti-Human Rights Crime -Based on the Decision of the Constitutional Court(2014Hun-Ba148)-

The Constitutional Court recently ruled that it was unconstitutional to require the application of the objective starting point among the provisions on the statute of limitations on the abolition of the civil law to the "civilian group sacrifice case" and the "serious human rights violation incident or allegation of manipulation case"as stipulated in the Article 2, Paragraph 1, Clauses 3 and 4 of the Truth and Reconciliation Commission Act.
It was decided to apply the subjective point of departure to the anti-human rights crime by adopting the subjective point system as the standard of the age limitation point in the amendment of the Estimation Law of each countries in the world and the case of claiming the damage due to the infringement of the human life body, It is related to the special protection for the physical good.
In the amendment of the statute laws of each countries, the general agendas were changed from the objective system to the subjective system, which introduced the discovery rule. It was early regarded as a wrongful act with regard to the ‘cause of action accrued’. The cause of the illegal act is considered to have been damaged in case of illegal act regardless of the damage. Therefore, the time limit for tort is deemed to have occurred at the time of the wrongful act.
However, the damage was not seen, but later problems appeared. Typical examples are intentional negligence litigation, asbestos-related environmental litigation, and child sexual abuse (CSA). This is called "delayed discovery." An anti-human rights crime is an act that violates the life and body of the people in a systematic and massive way through the national public authority due to the nature of the crime. As a result of the truth-clarification decision, criminals, illegal acts, causal relationships and damages by the perpetrator were confirmed. This has the same characteristics as the starting point of prescriptions worldwide. In this regard, the decision of the Constitutional Court has so far determined that the prescription for anti-human rights crimes is not treated in the same plane as general illegal activities. It is significant in the points that it considers the nature of crimes against humanity and the trend of prescription in Tort Laws of many countries around the world.

국문 초록 (Abstract)

헌법재판소는 최근 반인권 국가범죄인 진실화해위원회법 제2조 제1항 제3호 및 제4호에 규정된 ‘민간인 집단 희생사건’과 ‘중대한 인권침해사건‧조작의혹사건’에 민법의 소멸시효 규정 중 객관적 기산점을 적용하도록 하는 것은 위헌이라는 결정을 하였다. 반인권 국가범죄에 대한 주관적 기산점 적용을 결정했는데 이는 세계 각국의 시효법 개정에서 시효 기산점의 기준으로 주관주의 기산점체계를 채택한 것과 사람의 생명 신체에 침해로 인한 손해배상청구의 경우 최장기간을 배제하여 생명 신체 법익에 대한 특별한 보호와 관련 있다.
세계 각국의 시효법 개정에서 일반적인 시효 기산점을 객관주의 기산점체계에서 주관주의 기산점체계로 변경하였는데 여기엔 발견주의(discovery rule)를 도입한 것이다. 일찍이 소멸시효의 ‘청구원인이 시작할 때’(cause of action accrued)에 관하여 행위시(wrongful act)로 여기고 있었다. 따라서 불법행위 시효 기산점도 가해행위 때 손해가 발생한 것으로 간주하여 시효를 진행하였으나 손해가 눈으로 목도되지 않고 나중에야 확인되는 사안들이 나타나기 시작했다. 대표적인 예로 과실소송과 석면등 환경소송, 아동성학대(CSA)이 그러하다. 이를 ‘지연된 발견’이라 하여 원고가 피해 사실과 그 피해가 피고의 위법행위에 기인함을 “발견했거나 합리적 주의의무를 통해 발견 가능했을 때”부터 청구의 원인이 발생한다고 보아 이때부터 시효 진행되는 것으로 본다.
반인권 국가범죄는 범죄의 특성상 국가 공권력을 통해 조직적이고 대량적으로 자국민의 생명‧신체를 침해한 행위로 진실화해위원회의 진실규명결정이 있는 후 가해자와 가해행위, 인과관계 및 그로 인해 손해발생을 확인할 수 있는 사안으로 세계 각국의 기산점이 변동된 사안과 동일한 특징을 가지고 있다.
이러한 점에서 헌법재판소의 결정은 이제까지 반인권 국가범죄에 대한 기산점을 일반 불법행위와 동일한 평면에서 다루었던 것과는 달리 반인권 국가범죄의 특성에 중점을 두었다는 점과 세계 여러 국가들이 처해있는 불법행위에 관한 시효의 난제들을 고려하였다는 점에서 중대한 의의를 갖는다.
