장애차별금지법과 장애인의 경제적 복지- 미국의 미국장애인법과 소득보장정책의 긴장관계를 중심으로 - = Disability Anti-discrimination Law and Economic Welfare of People with Disabilities: Tensions Between the ADA and Income Security

다국어 초록 (Multilingual Abstract)

This study shows that the disability anti-discrimination law has limitations in improving the employment of people with disabilities and that the tensions between the ADA and Income Security Program has been appeared in the United States. These tensions are found from the introduction of the ADA to the implementation of it, which are attributed to the assumption that these two policies are based on incompatible paradigms. It is likely to lead to dangerous results of reductions in income security or combination with workfare. But these two policies should be seen as the two pillars serving the same goal, securing the economic welfare of people with disabilities. Therefore it is very important to reconcile with one another. It is needed that we know the contributions and limitations of the disability anti-discrimination law and reestablish the status of income security programs.

국문 초록 (Abstract)

본 연구는 미국의 ADA 사례를 통해 장애차별금지법이 장애인의 고용상황을 개선하는 데 한계가 있음을 보이고, 경제적 복지라는 큰 틀에서 서로 보완적인 관계에 있어야 할 장애차별금지법과 소득보장정책이 서로 긴장관계에 놓여 있는 맥락을 비판적으로 고찰하였다. 이러한 긴장관계는 ADA의 도입과 실행을 둘러싼 전 과정에서 발견되는데, 두 정책이 매우 상반된 패러다임에서 비롯되었다고 가정되기 때문에 발생한다. 이처럼 장애차별금지법과 소득보장정책을 이분법적으로 사고하는 것은 소득보장정책의 축소 및 근로연계복지와의 결합으로 이어질 위험을 안고 있다. 따라서 두 정책의 조화로운 관계를 구축하는 것이 중요하다. 이를 위해서는 장애차별금지법의 의의와 한계를 정확하고 인식하고 소득보장정책의 위상을 장애인의 사회권이라는 관점에서 재정립하는 것이 필요하다.
