실존적 자연법론에 있어서의 법의 역사성

국문 초록 (Abstract)

현대자연법론을 위협하는 가장 심각한 과제로 제기되는 것이 법의 역사성의 문제이다. 실존적 자연법론은 역사적 존재론의 입장을 취하는 실존철학을 법철학에 도입하여 자연법의 역사내재화를 구명하는 이른바 실존적ㆍ역사적 자연법론을 전개함으로써 법의 역사성의 문제를 해결하려고 시도한다.
실존적 자연법론은 기본적으로는 토마스주의에서 발전되어 온 존재론에 근거하면서도 실존철학에 의해 개척된 현존재 분석의 성과를 흡수하면서, 법을 그 본질로서의 자연법성과 실존으로서의 실정성 혹은 그 본질에 있어서 영원성과 그 실존에 있어서 역사성과의 두 계기에서 이루어진 실재로서 인정한다.
이렇게 함으로써 실존적 자연법론은 법의 기본적인 본연의 모습, 즉 존재론적 구조를 양자(자연법성과 실정성)의 「긴장통일」로 파악하고, 더 나아가 법의 역사성의 문제를 존재론적으로 근거지우려는 것이다.

다국어 초록 (Multilingual Abstract)

The historical aspect of a law is the most important problem in present-day the theory of natural law. The existential natural law is a theory that posits the historical aspect of a law whose contents is set by existence and history introducing the existentialism.
The development of this tradition into one of natural law is usually attributed to the ontology progressed by Thomism. The existential natural law recognize both natural and existential(positive legislation) aspect in nature of law and both their eternity and historical characteristic processing fruits of 'being-in-the-world (Dasein)' analysis evoloved by the existentialism philosophy.
In this way, the existentialism of natural law has described legal aspect which should be as the relation of the tensional unity(Spannungseinheit) between natural law and positive legislation. Furthermore, in this point of view, it has attempted to resolve the historical aspect of law on the basis of existentialism.
