일본의 최고재판관 국민심사제와 그 시사점 = Japanese National Review for Judges of Supreme Court and Its Implications

국문 초록 (Abstract)

재판과정은 국민에 대하여 열려 있어야 하며 국민들이 적극적이고 능동적으로 재판과정에 참여할 수 있는 기회가 확대되어야 한다. 또한 법관의 판단과 그 전제가 되는 법의 해석원리의 형성 또한 시민사회의 다양한 가치들을 반영하여 이루어지고 또 수정?변화하도록 해야 한다. 이것은 입법부와 행정부에 비해 민주적 정당성이 취약한 우리나라의 사법부에 반드시 보완되어야 하는 가치이기도 하다. 이웃나라 일본의 헌법은 최고재판소 재판관에 대한 국민심사제를 직접 규정하고 있다(일본국헌법 제79조 제2, 3, 4항). 이것은 내각이 임명한 최고재판관을 국민의 직접선거에 부쳐서 자격이 없다고 판단하는 의견이 총 투표수의 과반수가 되면 해당재판관을 파면하는 제도이다. 이것은 국민주권의 원리에 입각하여 사법기관에 대한국민의 정당성을 직접 부여하기 위해 만들어진 제도이다. 이 논문에서는 직접투표를 통하여 국민이 최고재판소 구성에 참여하는 일본의 국민심사제를 고찰함으로써 특히 민주적 정당성이 취약한 우리 헌법재판소 구성에 새로운 실마리를 찾아보고자 한다.
