우리나라 기체결 FTA 및 TPP의 서비스 협정문 검토

다국어 초록 (Multilingual Abstract)

We already finished many FTAs with large economies and now we are preparing to join the TPP. At this moment, it needs to screen FTAs that we signed before because it is helpful for performance of FTAs and establishment of strategies to future FTAs. This study focuses on the Service Chapters in Korea-China FTA, Korea-Australia FTA, Korea-New Zealand FTA.
There are some comments after examination. Firstly, regarding the scope, Service Chapters shall not apply the air transport services or related services except certain areas. Because the exceptions are different in every FTA, it is necessary to check whether the sensitive areas are excluded and the strong areas are open. Secondly, our FTAs does not maintain consistency about regulation of mode 3. It can cause confusion in implementation of FTAs. It is better to have consistent position regarding this issue because it is related to a basic structure of Agreement. Thirdly, in our certain FTAs, there are provisions accord future MFN status to the other Party except some areas. Given the admission of TPP, we must be cautious with having same MFN provisions like ex-FTAs in the future. Finally, in part of domestic regulations, the contents of most Service Chapters are similar, however, we have to pay persistent attention to the results of the WTO negotiations related to domestic regulations. Because if the results of the WTO negotiations enter into effect, domestic regulations provisions shall be amended under an agreement.
