The local-based housing association scheme is a special exception to the ordinary housing supply procedures under the Rules on Housing Supply. It permits non-homeowning end-users to directly undertake the construction of the housing in which they intend to reside. In its original design, the scheme presupposed a trust-based personal association in which members would share project costs and risks. Since its introduction, however, the increasing complexity of housing construction projects and changes in development conditions centered on large-scale housing sites have led to a structure in which construction companies or developers plan projects and take the lead in recruiting association members. As a result, members of local-based housing associations have come to occupy a dual position: they remain constituents of the project entity, but in practice closely resembling ordinary purchasers.
Within this transformed project structure, when a project is delayed or ultimately fails, those who have effectively led the project tend to retreat from responsibility, while the members are left to bear the risks according to the original logic of the scheme. In response, the 2016 amendments to the Housing Act strengthened protective measures for members, including disclosure duties, advertising regulations, and access to project-related materials. At the same time, however, by introducing the report on recruitment of members, the amendments also had the effect of incorporating the transformed project structure into the legal order of the Housing Act. Against this background, if joint liability based on a partnership under the Civil Act between a construction company and a local-based housing association is denied merely on the ground that, prior to project plan approval, the construction company is not yet a joint project entity under the Housing Act, such an approach would be overly formalistic and fail to reflect the practical substance of the relationship. Courts have generally addressed disputes concerning the legal status of association members through civil-law doctrines, but this approach remains limited insofar as it results only in ex post and case-specific adjustments without sufficiently considering the position of the local-based housing association scheme within Korea’s housing supply system.
This article understands the local-based housing association scheme as a limited exception within the housing supply system and examines the regulatory direction required if the transformed project structure is to be maintained. If the legal system accepts a structure in which construction companies or developers take a leading role from the stage of recruiting association members, then the responsibilities corresponding to that role must also be strengthened. At the same time, even where members are recruited in a manner similar to ordinary purchasers, their responsibility as constituents of the project entity cannot be denied. Legislative supplementation is therefore required to ensure that, at the time of joining, members can sufficiently understand the scope of their responsibilities and the risks arising from increases in project costs and delays in project implementation. If profit generation through general sales becomes the primary purpose of the project, or if the basic premise that members share project-related responsibilities is denied, the legitimacy of the local-based housing association scheme can no longer be recognized.
