In Korea, numerous cases exist in which forest land has been illegally converted to agricultural land or residential sites during the process of industrialization and urbanization and has been continuously used for extended periods. However, the registered land category in the cadastral records often remains classified as forest land. Such land category mismatches not only restrict landowners' property rights but also undermine the accuracy of national spatial information, distort land-use statistics, and reduce administrative efficiency. This study examines the forest land conversion permit system, the Substitute Forest Resources Creation Fee system under the Forestland Management Act, and the temporary special measures previously implemented for illegally converted forest land. Based on this review, the study analyzes the underlying causes of persistent land category mismatches. The results indicate that these mismatches are not merely the consequence of individual illegal activities, such as unauthorized land reclamation, but rather represent a structural problem arising from multiple factors. These include the institutional separation between cadastral administration and forest administration, the uniform regulatory framework applied to lands that have been continuously utilized for long periods, and the financial burden imposed by the Substitute Forest Resources Creation Fee.
