집회시위에서의 치안드론 도입 및 활용에 관한 연구 = A Study on Introduction and Use of Police Drones at Assembly and Demonstration

국문 초록 (Abstract)

4차 산업혁명이 급격히 진행되면서 미래 스마트시티의 핵 심 기술인 드론 산업도 빠르게 발전하였다. 최초 군사용으로 개발된 드론은 산업과 생활 전반에서 다양한 용도로 활용되고 있으며, 형태와 활용 영역을 계속 확장하고 있다. 이러한 흐름 속에 새로운 산업에서 우위를 점하려는 경쟁이 치열하게 전개 되면서 정부가 주도하는 드론 산업 육성 정책의 일환으로 경 찰 드론이 운영되기 시작하였다. 이후 경찰 드론은 다양한 수 색 현장에서 상당한 성과를 거두었으나, ‘수색’ 업무에만 제한 적으로 운용된다는 비판을 받아왔다. 최근 경찰은 드론의 운용범위를 확장하여 다양한 경찰 업무 에 활용하는 방안을 추진하고 있다. 이태원 참사와 노조의 불 법집회 등을 계기로 드론의 필요성과 긍정적인 효과들이 다수 제시되었지만, 개인정보침해 등에 대한 우려는 여전하다. 특히, 드론 도입을 추진하고 있는 경찰업무 중 집회시위는 국민의 기본권 행사라는 점이 더해 치안드론 도입에 대한 반대가 상 당한데, 이와 관련된 논의와 연구는 부족한 실정이다. 따라서 본 연구는 경찰이 집회시위로 치안드론의 운용 범위 를 확대하는 과정에서 고려해야 할 쟁점들을 탐색하고, 해결방 안을 모색하기 위해 수행되었다. 연구 방법은 문헌 연구와 전 문가 의견 조사를 병행했는데, 문헌 연구를 바탕으로 드론과 집회시위에 대한 개념, 해외 치안 분야에서의 드론 활용 사례, 드론 도입에 관한 기본적인 쟁점들을 탐색한 후 집회시위, 법· 제도, 드론 기술 분야의 전문가 인터뷰를 통해 추가적인 쟁점 을 도출하고 해결방안을 제시하였다. 연구 결과 집회시위에 치안드론을 활용하기 위해서는 법적 근거와 사용 절차가 명확하게 정리되어야 하며, 안전성 확보와 국민의 지지가 중요하다는 점을 도출하였다. 개선방안으로는 개정 ‘경찰 무인비행장치 운용규칙’ 제9조의 운용범위에 대한 명확한 해석, 드론 구매절차 개선, 안전 기준을 담은 매뉴얼 마련, 안전장치 부착, 사고 이후 보상 체계 정비, 정확한 정보 와 국민 참여를 통한 정책 홍보 등을 제시했는데, 특히 논란의 핵심인 개인정보 침해 우려를 완화하기 위한 방안으로 촬영 결과물에 대한 보관, 삭제, 사용 기준 정비·공개와 열람 또는 이의 제기와 같이 비례의 원칙을 준수한 균형잡힌 시스템이 필요하다는 점을 강조하였다. 결론적으로, 집회시위에 치안드론을 활용하는 문제는 새로운 경찰 장비를 도입하는 것을 넘어, 국민의 기본권이 연관되고, 경찰 활동의 패러다임이 바뀌는 중요한 사안이다. 집회시위에 치안드론을 운용하면서 본 연구가 제시한 쟁점들이 참고자료 로 활용되기 바라며, 심도있고 종합적인 후속 연구가 이어지기 를 기대한다.

다국어 초록 (Multilingual Abstract)

As the 4th Industrial Revolution progresses rapidly, the drone industry has also developed swiftly. In line with this trend, amid intensifying competition to gain a foothold in this emerging industry, the operation of police drones has been initiated as part of a government-led policy to foster the drone industry. While police drones have demonstrated significant effectiveness in various search operations, they have faced criticism for being primarily limited to 'search' tasks. Recently, the police have put forth plans to broaden the operational scope of drones and employ them in various police tasks. Despite the presented necessity and positive impacts of drones following incidents such as the Itaewon disaster and illegal union gatherings, concerns persist regarding the infringement of personal information. Notably, there is substantial opposition to the introduction of security drones, particularly concerning assembly demonstrations, as they constitute an exercise of citizens' basic rights. However, there is a lack of discussion and research in this regard. Consequently, this study was conducted to explore the issues that the police should consider in the process of expanding the operational scope of security drones to include demonstrations and to propose solutions. The research methodology involved a combination of literature review and an expert opinion survey. The literature study delved into the concepts of drones and demonstrations, cases of drone use in overseas public security, and fundamental issues related to the introduction of drones. Additional issues were identified, and solutions were presented through interviews with experts. The study concludes that, for the utilization of security drones in rallies, a clear legal basis and operational procedures must be outlined, and ensuring safety and garnering public support are crucial. Proposed improvement measures include a clear interpretation of the operational scope of Article 9 of the revised 'Police Unmanned Aerial Vehicle Operation Rules,' enhanced drone purchase procedures, the development of a manual containing safety standards, attachment of safety devices, establishment of a compensation system after an accident, provision of accurate information, and public participation. Particularly, to address concerns about personal information infringement, a balanced approach adhering to the principle of proportionality is suggested. In conclusion, the issue of using security drones in protests transcends the introduction of new police equipment. It involves the basic rights of the people and transforms the paradigm of police activities. The study hopes that the issues presented will serve as reference materials for using security drones in demonstrations and encourages further in-depth and comprehensive follow-up research.
