국내 주도형 특허풀의 결성 및 운영에 관한 연구 = A study on organization and administration of a patent pool led by Korean patentors

국문 초록 (Abstract)

국가와 기업들에게 특허전략의 중요성은 이미 오래전부터 강조되어 왔다. 최근들어 기술융합이 가속화되고 국제 표준화 활동이 늘어남에 따라 지재권과 관련하여 새로운 문제가 많이 발생하고 있으며 이에 대한 전략적 해결책의 일환으로서 특허풀이 주목받고 있다. 특허풀을 통해 특허를 가진 기업은 로열티 수입을 극대화할 수 있고, 표준을 실시하는 기업은 개별 라이센싱에 비해 상대적으로 저렴한 로열티로 한번에 필수 특허를 확보할 수 있다는 인식이 더해지면서, 특허풀에 대한 기업들의 관심은 나날이 높아지고 있다.
세계적으로도 여러 기술분야에서 특허풀을 구성하기 위한 기술강국들의 정부차원의 노력이 이루어지고 있다. 우리나라는 자동차, 조선, 철강, 전자 등 다양한 분야에서 비약적인 기술발전을 이룩하여 왔으며 최근에는 세계 최고수준의 'IT 강국'으로 인정받고 있으나 지식재산권의 측면에서의 경쟁력은 이에 미치지 못한 것이 사실이다.
국내에서도 우리의 역량을 집중할 수 있는 기술분야를 전략적으로 선택하여 특허풀이 결성되면, 우리 기업들은 특허권의 효과적인 행사와 함께 합리적인 조건으로 서로의 특허를 이용할 수 있게 될 것이다.
분명 특허풀은 특허 보유자와 사용자 모두에게 필요한 성공전략이며 지식산업의 발전을 위해 국내 특허풀의 활성화는 매우 긴요하다. 우선 국내 주도형 특허풀의 결성으로 첫걸음을 내딛게 하고 계속해서 크고 작은 특허풀이 결성되도록 여건을 조성함으로써 특허 경쟁력도 강화하고 세계적인 특허풀의 탄생도 앞당길 수 있을 것이다.

다국어 초록 (Multilingual Abstract)

The importance of patent strategies for nations and companies has already been emphasized. As technological convergence has accelerated, and international standardization has increased, many problems about intellectual property have recently arisen. Patent pools are thought to be one of the significant solutions to such problems. In intellectual property(IP) law, a patent pool is a consortium of at least two companies agreeing to cross-license patents and other IP rights relating to a particular technology.
Organization of a patent pool can save patentees and licensees time and money. Patent pooling has recently become a hotly discussed field. Generally, governments of technologically advanced countries support the formation of patent pools in many technological fields. South Korea has highly developed science and technology sectors, and is known for world-class information technology(IT).
But South Korea's competitiveness in regard to intellectual property rights is not equal to its level of technological development. If Korea were to strategically select certain technological field, and form patent pools, Korean companies could more efficiently exercise and use their patents. Therefore, a patent pool is a necessary strategy to both patentees and licensees. Forming a domestic patent pool is important to develop intellectual property-based industry. If Korea takes the initiative to organize domestic patent pools within selected technological fields, it can soon begin to continuously form other pools, and thereby strengthen its competitiveness.
