산지관리 및 전용허가제의 개선방향에 관한 연구 = A Study on the Improvement of Forest Land Management and Permission System of Forest Land Use Conversion.

국문 초록 (Abstract)

현행 산지이용체계는 녹색성장 패러다임과 친환경적인 관리를 실천하는 데에는 역부족이다. 한번 산지전용이 이뤄지면 생태적 측면보다는 경제적 효율성 중심으로 개발이 이뤄지고 향후 증축 등으로 고밀도로 개발되는 것이 보통이다. 이에 따라 산지를 개발과 보존의 조화를 도모하여 난개발 방지와 친환경적인 산지이용을 할 수 있도록 산지이용구분과 행위제한 및 산지전용허가 제도를 효율적으로 운영해야 한다.
본 연구는 산지관리 및 산지전용허가제와 개발행위허가의 개념 정의에서부터 진정한 개발관련 계획 체계 등을 위한 분석을 하고 그 에 따른 법률들을 분석하여 문제점과 개선 방안을 제시하였다.
우리나라의 산지는 각 지역별로 산지의 입지 환경적 여건이 다양함에도 불구하고, 산지전용허가기준은 전국적으로 동일한 기준을 적용하고 있기 때문에 산악지역과 평야지역간의 산지이용 및 개발에 있어서 역차별 문제가 발생하고 있다. 이를 해소하기 위해서는 각 지역별 산지의 입지 환경적 여건을 감안하여 산지전용조건을 다양화하거나 상대적으로 산지개발이 어려운 지역에 대한 보상적 개발인센티브를 제공할 필요가 있다.
산지를 자연 친환경적으로 관리와 개발이 이루어질 수 있도록 산지에 대한 개발 수요와 보전에 대한 필요성을 합리적으로 반영한 산지관리 및 전용허가 기준의 개선 작업이 필요하다.
또한, 연접개발제한 허용여부를 결정하는 도시계획위원회의 보다 투명하고 공정한 운영방안을 모색할 필요가 있으며 도시계획위원회의 위상이 대폭적으로 강화되어 도시계획위원회의 구성 및 기능재편도 함께 이루어져야 한다.
향후 연구에서는 산지를 개발할 경우 각각 개별법 기준을 적용하므로 발생하는 민원 사례를 분석하여 산지관리 및 전용허가제에 관한 실제 현장에서 이루어지는 실태를 심도 있게 분석함으로써 향후 효율적인 산지전용허가제의 개선 방향에 관한 연구가 필요할 것이다.

다국어 초록 (Multilingual Abstract)

Current forest land use system is inadequate to practice sustainable forest land management and green growth paradigm. After conversion from a mountainous district, people attempt to high-density development for economic purposes rather than ecological ones. Therefore, it is important to run forest land use classification, restriction on acts and conversion from a mountainous district permission system effectively to prevent unplanned land development and to use mountains environmentally.
This study proposed problems and improvements through an analysis of definition of forest land management, conversion of a mountainous district permit system, planning system of development and related laws.
Even though characteristics of Korean forest land and the difference between plains and mountains vary depending on different areas, nationally uniform standard is applied to permission system of the forest land use conversion and this phenomenon is cause of reverse discrimination. To solve this problem, on the basis of environmental conditions of forest land in each area, we should vary condition for forest land use conversion and give compensative incentives to areas where forest land development is relatively hard.
Improvement of standards for permission system of forest land use conversion which rationally reflect necessity of demand for forest land development are required to manage and develop forest land eco-friendly.
In addition, we need to seek city planning commission’s fair and clean management plan that decide permission yes or no about restriction to neighboring area development.
Hereafter researches need study about improvement direction of efficient permission system of forest land use conversion through analysing real condition of forest land management and permission system of forest land use conversion with analysing case of civil appeal which occur if individual law is applied when develop forest land.
