This discussion aims to systematically analyze legal issues related to liens in real estate auctions and to suggest effective improvement measures. First, we examine real estate auction procedures, the concept and establishment requirements of liens, and the legal nature of liens to lay the foundation for the liens system. Next, we discuss major issues that arise in real estate auctions in depth. In particular, we analyze criminal issues related to false liens to clarify the negative impact of false liens on auction procedures. In addition, we examine legal and practical issues arising from conflicts between liens and auction procedures, and discuss legal issues in situations where the protection of third-party rights and the priority of liens conflict.
Based on this, we propose improvement measures. We present measures to clarify criminal responsibility and strengthen sanctions through legislative improvement measures to prevent false liens, and discuss measures to strengthen the effectiveness of liens examination in auction procedures.
Furthermore, by establishing a coordination measure to protect the interests of third parties, the foundation for the right of retention to operate more fairly and rationally is laid. This study emphasizes the necessity of solving practical problems and institutional improvement through the harmony of real estate auction and right of retention system, and presents specific directions and tasks for this.
