미국 식품의약품 안전관리의 중앙ㆍ지방간 업무 관계 연구 = A Study of Federal-State Cooperation for Food and Drug Safety Management in FDA ORA

This study aims to analyze the changing patterns of relationship between central and local government in food and drug safety management. It is the purpose of this study to provide informations for integrating and coordinating the operational functions of organization and workforce of KFDA. This research consists of three parts. First, we review concepts and theories about the centre-local relation or intergovernmental relation and patterns of their interactions. Based on this review, we can divide duties effectively and take appropriate charge of the work between central and local government in food and drug safety management. Secondly, we focus on organizations and duties of the ORA(Office of Regulatory Affairs), the lead office for all field activities of the FDA(Food and Drug Administration) in USA. The Division of Federal-State Relations (DFSR) in ORA interacts with, and serves as the focal point for cooperating state and local officials, and associations of these state officials, to promote cohesive and uniform policies and activities in food and drug-related matters. Thirdly, we reexamine organizations and duties of KFDA and the relationship between KFDA and local government, compared with advanced countries redesigning food safety system recently. We propose to strengthen the role of KFDA in food and drug safety, restructure the function of local KFDA offices and effectuate partnerships with local government in the commitment to safeguard the public health.

국문 초록 (Abstract)

○ 연구목표 : 이 연구는 현재 우리나라 식품의약품 안전관리에 있어서 정부 기관 간의 원활한 협조체제가 이루어지지 못하고 있다는 전제 아래, 중앙기관과 지방기관간의 협조 체계 구축을 위한 사전 연구로서의 성격을 지닌다. 따라서 이 연구는 미국 FDA ORA가 식품의약품 안전관리에 있어서 중앙, 지역, 주 간의 협력 관계를 어떻게 구축하고 있는지를 심층 분석함으로써, 우리나라 식품의약품 안전관리체계를 개편하는 데 참고자료를 제공하는 것을 목표로 한다.
○ 연구 내용 : 이 연구 크게 세 부분으로 구성된다. 세 부분은 서로 논리적으로 엄밀하게 연결되지는 않지만 식품의약품 안전관리에 있어서 중앙정부와 지방정부와의의 관계를 모색하는 데 도움이 되는 많은 정보들을 줄 수 있을 것이다. 첫째, 연구와 관련된 이론적 배경을 검토하기 위하여 중앙정부와 지방정부의 관계에 대한 일반 이론들은 살펴본다. 이 이론들에 근거해서 본 연구의 분석틀을 구성하되, 식품의약품 안전관리 업무의 특성을 고려하여 분석 틀을 엄격히 적용하기 보다는 연구의 전체적인 방향을 설정하는 데 참고한다. 둘째, 본 연구의 가장 핵심적인 부분으로, 미국 FDA의 중앙과 지방 간 협력체계를 분석한다. FDA 조직 체계는 크게 본부조직, 지방조직, 지원조직으로 나눌 수 있는데, 이 연구에서는 FDA 내에서 지방조직을 관장하는 규제실(Office of Regulatory Affairs: ORA) 업무를 집중적으로 분석한다. 셋째, 위의 분석을 기초로 우리나라 식품의약품 안전관리 체계의 중앙과 지방 관계의 현황과 문제점을 분석하고 가능한 개선방안을 제시한다. 특히 식품의약품안전청과 지방청 그리고 지방정부와의 관계를 분석함으로써 향후 식품의약품 안전관리체계를 개편하는 데 도움이 되는 자료를 제공한다.
○ 연구성과(응용분야 및 활용범위 포함) : 미국 FDA ORA를 중심으로 식품의약품 안전관리와 관련된 중앙정부와 지방정부의 역할과 기능을 체계적으로 정리함으로써, 기존 식품의약품 안전관리 체계의 문제점을 확인하고 그 개선 방안을 제시하는 데 참고자료를 제공한다. 이와 함께 식품의약품 안전관리에 있어서 중앙정부와 지방정부 사이의 적절한 역할 분담 방안을 모색하여 식품의약품 안전사고를 사전에 예방하며 사고 발생시신속하게 대응할 수 있도록 하는 데 기여한다. 식품의약품 안전관리와 관련하여 식품의약품안전청의 역할과 기능을 재검토하고, 본청, 지방 식품의약품안전청, 지방자치단체 사이의 적절한 업무 배분을 모색하는 데 참고자료로 활용한다.
