This paper attempts to analyse the US Congress bills for climate change in terms of competitiveness concern. Bills proposed in 110th session proposed 'border measure' to offsets the competitive advantages of import goods from foreign countries where the 'comparable measures' are not taken. Bills of 111th session, however, focused on 'emission allowance rebate' to compensate the additional costs from the compliance with the proposed regulations. This paper concludes that the border measure could be found to violate Artcle 3 of National Treatment of GATT 1947, while allowance rebate may conflict the Agreement on Subsidies and Countervailing Measures of WTO

국문 초록 (Abstract)

본 논문은 미국의회의 제110차, 제111차 회기에서 제안된 기후변화법안의 국제경쟁력에 관한 조항을 분석하고자 하였다. 분석의 결과 다음과 같은 결론이 가능하다. 첫째, 미국의회에 두 개의 회기 동안 제안된 기후변화법안은 미국 내 온실가스 배출을 규제하는데 있어서 cap-and-trade의 방향으로 나아가는 모습을 보여주고 있다는 것이다. 둘째, 각 법안은 온실가스 배출규제 방법이 어떻든 그러한 규제가 초래할 미국 산업의 국제경쟁력 저하를 보완하기 위하여 나름대로의 방안을 제시하고 있는바, 제110차 회기에서는 ‘국경조치’가, 제111차 회기에 제안된 법안은 ‘배출권 환급’을 주된 방법으로 하고 있다. 제110차 회기에서 제안된 국경조치는 GATT 3조, 내국민대우원칙의 위반의 가능성을 가지고 있었고 따라서 GATT 20조의 일반예외의 인정을 받지 못할 경우 국제무역법을 위반하는 결과를 초래할 수 있음을 지적하였다. 두 번째 대안인 ‘배출권 환급’은 WTO법의 보조금협정의 위반 가능성을 가지고 있었다. 특히 재정적기여, 경제적 혜택의 경우 그러한 조문의 요건을 충족시킬 가능성이 있고 반면 특정성과 피해의 판정은 그러한 법이 시행되지 않은 상태에서 실제 위반이 발생할지 판단하는 것이 어렵다는 것이 본 논문의 결론이다.
