    디지털 시대 데이터 주권 충돌은 전 세계 지정학적 구도와 디지털 경제 질서를 재구성하는 핵심 변수로 자리 잡았다. 이러한 충돌의 생성 메커니즘과 진화 규칙을 체계적으로 규명하는 것은 공공행정학이 전 세계 디지털 거버넌스 연구에 개입하고 학문적 연구 공백을 메우는 핵심 학술 과제이다. 기존 연구는 주로 국제관계학의 권력 게임, 국제법학의 규칙 충돌 또는 규제경제학의 준수 비용 관점에서 분석을 전개했다. 대부분 국가 이익을 외생적 출발 변수로 간주하여 거버넌스 모델이 이익 순위에 미치는 구조적 형성 작용을 간과했다. 또한 국가 능력을 단일 차원의 전체 변수로 보아 데이터 거버넌스 분야에서 행정 능력이 발휘되는 분야 특이성을 식별하지 못했다. 그리고 충돌을 있음과 없음의 이원적 상태로 단순화하여 충돌 격화의 단계성과 전환 메커니즘에 대한 체계적인 기술이 부족했다. 이로 인해 동일한 권력 구조에서 충돌 전략이 분화하거나 규칙은 유사하지만 충돌이 격렬해지는 등 핵심적인 역설을 완전히 설명하기 어려웠다. 본 연구는 공공행정학의 학문적 입장에 기반하여 거버넌스 모델이 행정 강도를 결정하고 데이터 주권 능력을 형성하며 최종적으로 충돌 생성을 촉진하는 전혀 새로운 인과 분석 프레임워크를 구축했다. 이를 통해 국가 행정 능력 이론을 데이터 거버넌스 분야에 체계적으로 확장한 최초의 연구로서 데이터 주권 충돌 연구에 학제 간 통합적 설명 도구를 제공한다. 연구는 비교제도분석, 정책 텍스트 코딩과 다중 사례 심층 과정 추적을 결합한 혼합 연구 방법을 사용하여 중미유 3대 디지털 경제체를 핵심 분석 대상으로 삼았다. 그리고 이론과 실증 검증의 세 가지 핵심 단계를 순차적으로 완료했다. 첫째, 집권형, 분산형, 초국가형 세 가지 거버넌스 모델이 국가 이익 순위와 전략 선택에 미치는 체계적인 형성 메커니즘을 밝혔다. 둘째, 행정 강도를 강제력, 규제력, 조정력의 세 가지 측정 가능한 차원으로 조작화하여 국가 이익이 데이터 주권 능력으로 전환되는 과정에 미치는 차별적인 조절 작용을 검증했다. 셋째, 능력 충돌이 충돌로 전환되는 이중 임계값 메커니즘을 제시하고 서로 다른 거버넌스 모델 조합에 대응하는 충돌 유형의 진화 규칙을 식별했다. 연구 결과 세 가지 거버넌스 모델은 각각 조정력이 강하고 강제력은 중등이며 규제력은 약한 조합, 강제력이 강하고 규제력이 뛰어나며 조정력은 약한 조합, 규제력이 강하고 조정력은 중등이며 강제력은 약한 조합의 체계적인 행정 강도 조합을 출력한다는 사실이 밝혀졌다. 행정 강도의 세 가지 차원은 각각 안전 보장 능력, 관할 능력과 이익 분배 능력의 형성 과정을 조절하여 동일한 전략 의도가 서로 다른 거버넌스 모델에서 차별화된 능력 조합으로 전환되는 심층적인 논리를 설명한다. 능력 충돌은 이익 접촉 임계값과 전략 대립 임계값을 순차적으로 돌파해야 하며 거버넌스 모델 조합과 능력 충돌의 주도 차원이 공동으로 충돌 유형을 결정한다. 그중 분산형과 집권형의 충돌은 안전 보장형 충돌을 일으키기 쉽고 분산형과 초국가형의 충돌은 대부분 관할권형 충돌을 발생시키며 초국가형과 다른 모델의 충돌은 주로 이익 분배형 충돌을 형성한다. 본 연구는 이론적으로 국가 행정 능력 이론의 적용 경계를 확장하고 데이터 주권 충돌 생성을 포괄하는 분석 프레임워크를 구축하여 데이터 주권 연구가 거시 구조 분석에서 미시 행정 과정으로 전환되는 것을 촉진했다. 실천적으로는 규칙이 통일되면 충돌이 해소된다는 인식 오류를 바로잡고 전 세계 디지털 거버넌스가 규칙 통일에서 능력 대화로 패러다임을 전환해야 한다는 점을 제시했다. 이는 중국이 데이터 주권 전략을 최적화하고 전 세계 디지털 거버넌스 규칙 제정에 참여하는 데 의사결정 근거를 제공할 뿐만 아니라 개발도상국이 집단적으로 디지털 패권에 대응하고 공정하고 합리적인 전 세계 디지털 거버넌스 체계를 구축하는 데 분석 도구를 제공한다.

    Tensions over data sovereignty are now reshaping global politics and the digital economy. Explaining why and how these tensions form is important for public administration to understand and address challenges in global digital governance. Previous research often examines this issue through global power struggles, legal rules, or regulatory costs. These studies usually treat national interests as fixed and overlook how different forms of governance shape what countries focus on. They also treat state ability as a single, broad trait, failing to recognize that government data management skills can vary across areas. Research further reduces conflicts to simple yes-or-no situations and fails to describe how conflicts start and change. Because of these limits, it's hard to explain why similar countries can have different conflict strategies, or why fierce conflicts happen even when regulations look alike. This study uses a public administration approach to create a new way to explain data sovereignty tensions. It argues that different forms of governance yield distinct administrative strengths. These, in turn, affect a country's ability to control its data and can cause conflicts. This is the first study to apply a detailed view of government capacity to data management, offering a tool for understanding these tensions across fields. This research uses a mix of methods, including comparing institutions, coding policy documents, and analyzing several cases in detail. The study focuses on China, the United States, and the European Union and proceeds in three main steps. First, it shows how centralized, decentralized, and supranational governance models affect what each country sees as important and how they plan their strategies. Second, it breaks down government strength into three parts: power to enforce, power to regulate, and power to coordinate, and checks how each affects the country's ability to turn its priorities into actual control over data. Third, it describes how clashes in these abilities can take different forms depending on the governance models involved. The study finds that each governance model creates a unique mix of government strength. In the decentralized model, governments are strong at coordinating, moderately strong at enforcing, but weak at regulating. In the centralized model, governments have strong enforcement and regulation but weak coordination. In the supranational model, regulatory strength is highest, with moderate coordination and weak enforcement. These three forms of government strength each shape how countries ensure security, claim authority, and share interests. The study explains how the same strategies can yield different government outcomes depending on the model. To turn ability clashes into conflicts, two barriers must be crossed: involvement of interests and direct confrontation. The type of governance model and the government's ability that is most at odds determine the type of conflict. When decentralized and centralized models clash, security issues arise; decentralized and supranational models clash over authority; supranational and other models usually fight over sharing benefits. This study expands the use of a theory about government capacity. It offers a broad framework for explaining tensions over data control and encourages research to focus more on how government actions drive these problems. In practice, the study challenges the idea that making all countries follow the same rules will end conflicts. Instead, it suggests that dialogue about abilities is needed. The findings help China adjust its data policies and join in making global digital rules. They also provide developing countries with ways to work together toward fair digital governance.
