동북아 지역인권제도의 모색: 유럽인권협약이 주는 시사점을 중심으로 = In Search of Northeast Asian Human Rights Regime: Lessons from the European Convention on Human Rights

국문 초록 (Abstract)

이 논문은 동북아 그리고 더 큰 지역범위로서 동아시아 지역인권제도의 모색과 관련하여 성공적 지역인권보호제도인 유럽인권협약의 성립과정과 그 운용으로부터 시사점을 도출한다. 이와 관련하여 시킨크가 중시하는 인권이라는 규범의 등장, 수용과 확립이라는 관점에서 접근한다. 인권은 국제관계의 현실주의 이론이 이해하는 것처럼 물리적 힘이나 이익의 속성보다는 어떻게 행동하는 것이 옳고 적절한 것인가에 관련되는 규범적 힘을 지니기 때문이다. 이러한 기본적 이해 하에서 본 논문은 동북아 지역 인권제도 모색을 위해 유럽인권협약의 사례로부터 다음과 같은 세 가지 시사점을 도출하였다. 첫째, 인권의 규범력에 대한 수용과 합의의 확대이다. 인권의 규범력 확립은 국가주권과의 상관관계 속에서 나타난다는 점을 감안하여 유럽인권협약이 이러한 측면을 어떻게 극복했는가를 라우터파흐트의 견해를 바탕으로 고찰하였다. 둘째, 인권의 가치에 헌신적인 학자들, 비정부기구들, 그리고 정부의 관련 공무원들로 구성된 하나의 인식공동체로서 ‘유럽통일운동’이 유럽인권협약 성립과정에 주도적 역할을 수행한 것처럼 동북아에서도 인권을 연구하는 학자들, 인권 분야 비정부 시민사회, 그리고 관련 주제를 다루는 정부관료들이 긴밀한 인식공동체를 형성함으로써 이 지역의 인권보호제도 모색에 큰 기여를 할 수 있을 것이다. 셋째, 유럽의 인권협약 가입국이 처음 비교적 공고한 자유민주주의를 운영하던 10개국으로부터 시작하여 오늘날 47개국의 회원국을 가지고 있는 것처럼 동북아 또는 동아시아 지역에서도 인권에 대한 가치를 공유하는 국가들끼리 먼저 지역인권제도를 형성하는 것이 중요하다. 그리하여 차차 이 지역의 다른 국가들, 이 지역의 인근지역까지 확대해나가는 것이 효과적일 것이다.

다국어 초록 (Multilingual Abstract)

This article attempts to draw some lessons for the quest of Northeast Asian regional human rights regime from the successful case of the European Convention on Human Rights(ECHR). It focuses on the emergence of human rights norm and its acceptance. The author draws three lessons from the ECHR. First, it is necessary to establish the normative power of human rights among the parties concerned. The normative power of human rights can be established vis-a-vis state sovereignty. The view and role of H. Lauterpacht on human rights and sovereignty are analyzed in this regard. Second, it is necessary to formulate an epistemic community composed of scholars, non-governmental organizations, and related government officials committed to the value of human rights. Third, it is advisable to start with a small number of like-minded states with sound human rights records and then gradually extend to other states in the region. It might be better for the jurisdiction of the regional human rights court and individual petition right to be optional in the beginning and then make them compulsory with time in the future Northeast Asian human rights regime.
