유럽연합 공동체디자인 제도에서의 개별적 특성의 판단에 관한 고찰 = A Study on the Requirement of Individual Character in Community Design of the European Union

다국어 초록 (Multilingual Abstract)

The requirement of individual character in the European Union's community design correspond to the requirement related to creativity in Korea. However, while the requirement related to creativity ask for the degree of creativity, the requirements for individual character do not ask the degree of creativity, but rather ask whether or not they are different from previous designs. This system of the European Union basically focuses on the economic value of design rather than the degree of creativity as a requirement for design protection.
As a result of examining the requirement for individual character in the European Union, it is questionable whether the requirement related to creativity in Korea are absolutely necessary as the requirements for design protection. In particular, creativity-related requirement in Korea are interpreted very strictly, so design registration is often rejected or invalidated due to lack of creativity. It is necessary to think about whether it is appropriate to interpret the requirements related to creativity so strictly.
It is necessary to evaluate the importance of design features in the judgment of individual character, which is similar to finding dominant features of design in the judgment of design similarity in Korea. In the practice of the European Union, factors that affect the importance of design features include the existence of prior designs, restrictions on the designer's freedom, the process of using the product, the type of product, and the size and proportion of design features. This practice related to the importance of design features in the European Union is expected to be a good reference for identifying the dominant features of design in Korean practice.

국문 초록 (Abstract)

유럽연합의 공동체디자인 제도에서 개별적 특성의 요건은 우리나라에서의 창작비용이성 요건에 대응하는 것이다. 그러나 창작비용이성 요건은 창작의 정도를 묻는 것에 비하여, 개별적 특성의 요건은 창작의 정도를 묻는 것이 아니라 선행디자인과 구분되는 것인지 여부를 묻는 것이다. 유럽연합의 이러한 제도는 기본적으로 디자인 보호의 요건으로 창작의 정도보다는 디자인의 경제적 가치에 중점을 둔 것이다.
유럽연합의 개별적 특성의 요건을 살펴 본 결과, 우리나라에서의 창작비용이성 요건이 디자인 보호의 요건으로 반드시 필요한 것인지에 대한 의문이 든다. 특히 우리나라에서의 창작비용이성 요건은 매우 엄격하게 해석되어, 이로 인하여 디자인 등록이 거절되거나 무효로 되는 경우가 많다. 과연 창작비용이성 요건을 그렇게 엄격하게 해석하고 운용할 필요가 있는지 고민할 필요가 있다.
개별적 특성의 판단 과정에서 디자인 특징들의 중요도를 평가하는 작업이 필요한데, 이는 우리나라에서의 디자인 유사성 판단에서 디자인의 지배적 특징 즉 요부를 찾아내는 작업과 유사하다. 유럽연합의 실무에서, 디자인 특징들의 중요도 평가에 영향을 미치는 요소로는 선행디자인의 존재, 디자이너의 자유도에 대한 제한, 물품의 사용 과정, 물품의 유형, 디자인 특징들의 크기 및 비율 등이 거론되고 있다. 이러한 유럽연합에서의 디자인 특징들의 중요도 평가에 대한 실무는 우리 실무에서의 디자인 요지 파악에도 많은 참고가 될 수 있을 것으로 본다.
이 논문의 초점은 기본적으로 유럽연합 공동체디자인 제도에서의 개별적 특성의 판단에 초점을 맞춘 것이므로, 우리 실무에서 이를 어떻게 반영할 것인지 여부는 후속 연구를 통하여 계속하여 고찰해 보고자 한다.
