｢국내입양에 관한 특별법｣의 제･개정 목적 실현을 위한 법적 과제 = Legal Issues for Realizing the Purpose of the Special Act on Domestic Adoption

국문 초록 (Abstract)

본 논문은 2025년 7월 19일부터 시행되는 국내입양특별법의 제정 목적과 그에 반하는 법 조항들의 문제점을 분석한다. 입양에 관한 국가 책임 강화에 초점을 맞춘 기존 논의와 달리, 본 논문은 국내입양특별법의 3대 목적을 영구적인 가정 제공을 통한 아동 최선의 이익 실현, 국내입양 활성화, 입양가정 권익 증진으로 규정하고, 이에 부합하지 않는 조 항을 지적하며 그 개선 방향을 제시한다. 이를 위해 국가의 책무, 지자체 사례결정위원 회, 양부모의 자격 요건, 결연위원회, 가정법원 허가, 입양의 원칙, 사후관리, 양육보조금 지급 등에 대하여 구체적인 개정안을 제안한다.

This paper analyzes the objectives of the Special Act on Domestic Adoption, which will come into effect on July 19, 2025, and examines the legal provisions that contradict these objectives. Unlike previous discussions that focused on strengthening the state’s responsibility for adoption, this study defines the three main goals of the Act as: ensuring the best interests of the child through the provision of a permanent family, promoting domestic adoption, and protecting the rights and interests of adoptive families. The paper identifies provisions that do not align with these goals and proposes directions for improvement. To this end, it suggests specific revisions concerning the responsibilities of the state, the case determination committee of local governments, adoptive parents’ eligibility requirements, the matching committee, family court approval, principles of adoption, and post-adoption follow-up.
