정보판단의 실패와 극단주의 폭력의 결합: 미 의회 의사당 난입사건의 분석과 국내 대응의 입법적 함의 = The Convergence of Intelligence Judgment Failures and Extremist Violence: An Analysis of the U.S. Capitol Attack and Legislative Implications for Domestic Response

국문 초록 (Abstract)

본 연구는 민주주의 사회에서 정보판단 실패가 초래하는 구조적 위협과 극단주의 폭력의 결합을 분석한다. 정보판단 실패는 단순 정보 부족이 아닌, 분석 프레임의 경직성, 정치 적 간섭, 조직문화의 왜곡 등 복합 요인의 결과로, 민주주의 질서를 위협한다. 미 의회 난입사건과 서울서부지방법원 난동 사례는 이러한 구조적 실패를 보여주며, 정보기관의 정당성과 책무성의 제고가 필요함을 시사한다. 특히 AI기반의 분석 확산이 판단 오류를 기계화된 편향으로 심화시킬 가능성을 지적하고, 이를 통제하기 위한 AI 분석의 법적 검증 및 윤리감독의 제도화, 정보분석 문화의 개혁, 독립적 감시체계의 구축, 마지막으로 경보 시스템의 정치화 방지를 제안하였으며, 현실적이고 실행 가능한 정책 수립에 기여 할 수 있는 가능성을 제시하였다는 점에서 정책적 의의를 가진다.

This study analyzes the structural threats posed by failures in information judgment within democratic societies and examines their connection to the rise of extremist violence. Such failures are not merely the result of insufficient information but arise from a combination of factors, including rigidity in analytical frameworks, political interference, and distortions within organizational culture all of which threaten democratic order. The U.S. Capitol attack and the Seoul Western District Court riot exemplify these structural deficiencies, underscoring the need to strengthen the legitimacy and accountability of intelligence agencies. Furthermore, the study warns that the growing reliance on AI-based analysis may exacerbate judgment errors through automated bias, emphasizing the necessity of institutionalizing legal verification and ethical oversight for AI analytics, reforming the culture of information analysis, establishing independent monitoring systems, and preventing the politicization of alarm mechanisms. In this regard, the study holds significant policy implications by offering practical and actionable directions for future policy development.
