Enraged by sex crime against young children committed by convicted sex offenders, the public has demanded that government do whatever is necessary to prevent sexual recidivism. The criminal justice system has aggressively used the statutes to prevent sex offenders from committing more sex crime. They have dramatically increased sentences for repeat offenders, including serious sex crime. However, our existing approaches for dealing with sex offenders are flawed. They fail to incarcerate some sex offenders who are dangerous for the community. Rather than fostering the rehabilitation of sex offenders, they often produce psychological pressures that are antitherapeutic. Thus, we propose the use of special sex offender reentry courts or sex offense courts to manage the risk that sex offenders will reoffend and to motivate them to participate meaningfully in rehabilitative programs. The traditional criminal system fails to address the underlying problems that cause recidivism. An array of innovative courts have emerged throughout the country in an effort to address the underlying problem of sex crimes. Therapeutic Jurisprudence can be regarded as a theoretical foundation for problem-solving courts and approaches. These courts adapt their processes to suit the sources of the problems. which are driving the actions that bring the wrongdoer to court in the first place. Sex offender courts, which are based on principles of Therapeutic Jurisprudence, can provide more intensive community supervision for a much larger group of sex offenders, while at the same time motivating them to change their attitudes and behavior. In addition, sex offense courts is to improve public safety by preventing future victimization. The therapeutic approach on sex offenders through sex offense courts and sex offender reentry courts can be successful in addressing sex offender assessment, treatment, and management so long as the focus rests on both community and offender rehabilitation. As a result, our existing flawed strategies should be modified or replaced by a scheme that borrow from the best practices of therapeutic jurisprudence and problem-solving courts.
