지방의회 입법보좌관제도의 도입 필요성과 법적 문제 = A Study on the legislative aide system for local assemblies

Korea is making great efforts to enhance democracy and local governments. Cases in point are the relocation of administrative capital and transfer of national affairs to outside of Seoul, which have gradually increased the local government’s capacities and workload and thus have brought about the need for the local assemblies to become more professional and efficient.
However, the level of professionalism and efficiency did not meet the required level. This is because of a lack of manpower to support the improvement in practice. Currently, institutions that provide aid to local assembly members are the expert members and the secretariat, which are not sufficient to fulfill the need. Moreover, authority to appoint them held by the heads of the local governments makes it difficult to voice their own opinions.
In light of these circumstances, I propose that the legislative aide system be adopted. Among local governments currently working toward the adoption of the legislative aide system are the Seoul City Assembly and Gyeong-gi Provincial Assembly. These two have enacted ordinances to adopt the legislative aide system, but the Supreme Court has struck them down, rendering such ineffective. Nonetheless, the two local governments are continuing to pursue this goal, and more local governments are participating in this effort.
As a means of adopting the legislative aide system, it is required to establish such through the amendment of the Local Government Law in principle. As an exception, the legislative intern system was proposed. Another effective measure would be the transfer of the power to appoint and dismiss expert advisers and the secretariat to the local assembly, which will enable them to have higher professionalism. The enhancement in the legislative activities and professionalism of the local assemblies through the adoption of the legislative aide system will greatly benefit the right and welfare of the local communities.

국문 초록 (Abstract)

우리나라는 민주화와 지방자치의 활성화를 위해서 많은 노력을 기울이고 있다. 그 대표적이라고 할 수 있는 것이 행정수도의 이전과 국가사무의 지방이전이다. 행정수도와 국가사무의 이전을 통해 지방자치의 역량과 사무의 양은 점점 증가하였으며, 이에 따른 지방의회의 전문성과 효율성 요구하게 되었다.
하지만 전문성과 효율성이 요구되는 만큼 나타나지 않았다. 이는 현실적으로 뒷받침 하는 인력이 부족하기 때문이다. 현재 지방의회 의원을 보좌하는 기관은 전문위원과 사무처가 있다. 그러나 이들만으로는 부족한 실정이며, 이들의 인사권을 지방자치단체의 장이 가지고 있어 올바른 목소리를 낼 수 없다.
이에 입법보좌관제도의 도입 제언하고자 한다. 현재 입법보좌관제도의 도입을 위한 대표적인 지방의회는 서울특별시의회와 경기도의회가 있다. 이들은 조례에 입법보좌관제의 도입을 제정하였으나, 대법원에서 패소하여 효력을 상실하였다. 하지만 서울특별시의회와 경기도의회는 꾸준히 노력을 하고 있으며, 다른 광역자치단체로 확산되고 있다.
이에 입법보좌관제도 도입을 위한 방안으로 원칙적으로 지방자치법의 개정을 통한 입법보좌관제도 확립이 필요하다. 예외적으로 입법인턴제도 도입을 제안하였다. 그리고 전문위원 및 사무처의 임면에 관한 권리를 지방의회로 이전하여 이들의 전문성을 높이는 것이 효과적일 것이다. 입법보좌관제도 도입을 통하여 지방의회의 입법활동 역량을 향상시키고 전문성을 증가시킨다면 주민의 권리 및 복리에 많은 도움이 될 것이다.
