국내 단체교섭구조 및 그 결정요인과 산업별 다양성: 국제비교적인 시각의 고찰 = Collective Bargaining Structure in Korea and Its Determinants and Their Diversities across Industries: An Analysis from an International and Comparative Perspective

This paper builds a theoretical framework on similarities and diversities in prevailing bargaining levels across some advanced nations and their industries through the review of the literature in English. This theoretical framework turns out to be useful to understand the establishment of enterprise bargaining currently prevailing in Korea. Despite the prevailing enterprise bargaining structure in Korea, this paper also illuminates and analyzes industrial diversities in prevailing bargaining levels: centralized bargainings in port service and city bus industries at nation- and region-levels respectively as well as recent emergence of industry bargaining in banking and health care industries in contrast to predominance of enterprise bargaining in chemical and metal industries. In addition, that theoretical framework could also explain the recent decentralization of the centralized bargaining structure in port services and city bus industries. Findings of this paper imply that the fundamental shift could not be made only by preferences and choices of unions without similar preferences and choices of employers in association with their nation- and industry-specific industrial relations environments.

국문 초록 (Abstract)

국내보다 앞선 산업화를 경험한 영국․미국․독일․일본 등의 선진국들의 단체교섭에 대한 경험을 담은 문헌 검토를 통해서 국가나 산업별로 지배적인 교섭수준이 어떻게 유사하거나 다르고 어떤 요인들에 의해 설명되는지에 대한 분석틀을 도출했다. 이 이론적 틀을 통해 국내의 국가나 산업별 지배적인 교섭구조를 규명하고 설명한다. 이런 국제비교적인 시각의 연구를 통해서 본 논문은 국내의 지배적인 기업별 교섭구조는 독일과는 대조적으로 미국이나 일본의 구조와 근접하고 그것은 이 선진국들의 경험처럼 산업화의 초기부터 형성된 정치․사회․문화적 환경이나 이와 관련된 정부 역할과 이들에 영향을 받은 노사관계의 역사, 노사정의 선택과 세력관계와 노조나 사용자들의 태도나 선택 등에 의해 설명될 수 있음을 보였다.
또 국내의 대다수의 산업에서 기업별 교섭구조가 지배적인 것과 대조적으로 항운하역업의 전국수준의 통일교섭, 자동차 운수 내 시내버스업의 지역수준의 교섭, 금융과 병원산업의 최근의 산업별 교섭의 성장을 다루면서 국내에서 산업별 교섭구조의 다양성을 확인했다. 또 이런 교섭구조는 동태적인 변화도 보여서 금속산업에서는 최근에 산업별 교섭이 시도되고 있고 반대로 항운업이나 시내버스업의 집중화된 교섭구조는 분권화의 조짐을 보인다. 국내의 이런 산업별 교섭구조의 다양성이나 최근 변화는 선진국들의 경우처럼 각 산업별로 다른 기업규모에 따른 산업구조, 정부 개입의 정도, 산업의 성장
단계, 노조의 이념이나 성장 경로, 사용자의 태도, 노사관계의 역사 등에 의해 설명된다. 본 연구는 국내의 단체교섭을 연구하는 데 산업이나 기업수준의 중시(meso) 혹은 미시(micro)적인 자료 수집이나 이론적 틀, 국제비교적인 시각 등이 중요함을 확인시켜 준다. 또 본 논문은 국내나 산업의 지배적인 기업별 교섭구조가 산업별 구조로 변하는 것은 노조의 선호나 시도만으로 가능한 것이 아니라 환경이나 다른 노사관계 주체들의 선호나 선택 등이 같이 부합해야만 가능함을 보여준다.
