전통적 화쟁사상과 현대적 ADR의 상관성 연구 = A Study on the Correlation of Traditional Hwajeng-sasang and Modern ADR

다국어 초록 (Multilingual Abstract)

The Korean society is faced with very complicated realities such as the decreasing population, fourth industrial revolution, environmental issues, multi-cultural families, and international relations. While we are now encountering a compounding human-transcending society with the IT industry and artificial intelligence, there are still many tasks to resolve such disputes and conflicts including lawsuits and civil complaints that must be resolved the individual, groups and the state. This background signifies that there is an explosive flooding of stereotypes that aim at achieving the values, ideologies, human rights, desires, etc. of individuals and groups. But it is difficult for the nation’s legal standards and judicial system to respond to and cope with all of such demands in a blanket like the past. Similarly, advanced industrial capitalist countries implemented the new ADR(Alternative Dispute Resolution) system for specialization of its courts, simplification of rulings, and lowering costs, etc. from the mid-20th century. This means to break way from dispute remedies using the court and to solve disputes with alternative methods rather than lawsuits. A similar system to that of today’s ADR is Korea’s traditional “Hwajeng-sasang(화쟁사상)”. Therefore, through a correlative study of traditional Hwajeng-sasang and the modern ADR, it will be possible to foster the Korean ADR for resolving disputes and further develop Korea’s traditional Hwajeng culture

국문 초록 (Abstract)

한국 사회는 인구감소, 제4차 혁명, 환경문제, 다문화 가정, 국제관계 등 매우 복잡한현실을 맞이하고 있다. 또한 IT산업과 인공지능(AI)의 복합적인 초일류 사회를 맞이하고 있지만 개인, 집단, 국가가 해결해야 할 소송과 민원 등 각종 갈등과 분쟁의 해결과제도 산적해 가고 있다.
이러한 배경에는 개인과 집단의 가치, 이념, 인권, 욕구 등을 관철시키려는 고정화된관념들이 폭발적으로 쏟아져 나오고 있음을 의미한다. 하지만 국가의 법규범과 사법시스템이 과거처럼 일괄적으로 이러한 모든 요구에 일일이 대응하고 또 대처하기란 어려운 현실이다. 이와 동일하게 20세기 중반부터 선진 산업자본주의 국가들은 법원의 전문화, 판결의 간소화, 비용의 저렴화 등을 위한 새로운 대체적 분쟁해결(Alternative Dispute Resolution)제도를 실행하게 되었다. 이는 기존의 법원을 통한 분쟁해결에서벗어나 소송이 아닌 다른 대체방식으로 분쟁을 해결하는 것을 말한다. 그런데 현대ADR제도와 유사한 것이 우리나라 전통방식의 “화쟁사상”이다. 따라서 전통적 화쟁사상과 현대적 ADR의 상관성 연구를 통해 분쟁해결에 관한 한국형 ADR의 육성 및 한국의전통 화쟁문화를 발전시킬 계기가 될 것이다.
