소년수형자의 교도소 내 피해와 가해 경험에 대한 연구 = Victimization and violence among Korean Juvenile Inmates

The purpose of the study is to figure out the extent of victimization and violence among Korean young inmates. Previous research on prison misconduct suggest that the younger inmates tend to have much more experience of being victimized and/or victimizing others within prisons than adult prisoners, and that the boundaries between being victimized and exerting violence are blurred.
Based on these previous findings about prison victimization and violence, this study set four research questions: First, how much and what type of victimization will be found among youthful inmates? Second, how much and what types of violence exist among juvenile prisoner? third, are there any differences between adult prisoners and young prisoners with regard to experience of victimization and violence? Fourth what factors can explain victimization and violence among young inmates? A survey was conducted for 108 young offenders residing in a juvenile correctional facility located in the south region of Korea. Analysis showed that Korean juvenile inmates have experienced far less victimization and violence than previous research expected. In addition the percent of being victimized and victimizing others among young prisoners were far lower than adult counterpart. Absorption to inmate codes explained a little variance of victimization but not that of violence. Thus, this study failed to explain the link between victimization and violence. The findings of this study seemed hot that consistent with previous findings. The reason can be found data collection process in that young prisoners did not feel safe during conducting questionnaire. Another possible reason may be that Korean young prisoners are more rule abiding than Western counterparts because of cultural heritage in which young people should show respect to adults through behaving what the norms and rules direct. More research should be followed to confirm the right interpretation.

국문 초록 (Abstract)

이 연구는 우리나라 소년 수형자들이 교도소 내에서 경험하는 각종 폭력행동과 피해의 규모를 파악하고자 하는 목적을 가지고 수행되었다. 청소년들의 폭력행동과 그로 인한 피해, 즉 학교폭력에 대한 우리사회의 각별한 관심과는 대조적으로 구금시설에 있는소년들의 폭력가해와 피해에 대한 관심은 거의 없다는 데 문제의식을 가지고 다음의연구문제를 설정하였다. 첫째, 소년수형자들의 폭력피해의 실태는 어떠한가? 그 유형은 무엇이고 그 빈도는 얼마나 되는가? 둘째, 소년수형자들의 폭력가해 경험은 얼마나되는가? 그 유형은 무엇이고 그 빈도는 얼마나 되는가? 셋째, 소년수형자들의 폭력피해와 가해의 경험을 성인수형자와 비교할 때 차이가 있는가? 넷째, 소년수형자들의 폭력피해경험과 가해행동을 설명하는 요인이 있는가? 김천소년교도소에 수용되어 있는 소년수형자 108명을 대상으로 설문조사를 한 결과소년교도소에서 발생하는 폭력피해와 가해의 규모는 예상보다 크지 않았다. 폭력의 유형을 네 가지로 나누어 살펴 본 결과 신체적, 성적, 금전적, 심리적 폭력의 피해와 가해경험을 가진 소년수형자들은 소수에 그쳤다. 이러한 결과는 여러 선행연구들의 주장과는 대조적인 모습이다. 또한 성인수형자에 대한 조사결과와 비교해 보았을 때에도 소년수형자들의 폭력피해경험과 가해경험은 상대적으로 낮았다. 더불어서 폭력피해와 가해행동을 설명하는 요인을 찾아내기 위한 분석결과 박탈모델과 유입모델의 변수들의 설명력이 크게 유의미하지 않았으며 피해와 가해의 중첩성도 발견하지 못했다. 끝으로 연구결과에 대한 추론과 연구의 한계를 제시하였다.
