Recently, there has been a vigorous movement to eradicate illegal content on the cyber space by increasing responsibility for the operators and service providers on the Internet as a countermeasure against social problems caused by a flood of illegal contents such as fake news through social media and the Internet. Specifically, the government is considering bills that significantly strengthen the responsibility and duty of intermediaries, including imposing separate responsibility for deleting and blocking illegal content of intermediaries and imposing hefty fines in addition to the responsibility of intermediaries under the Information and Communication Network Act, the Youth Protection Act and the Copyright Act. Germany s network enforcement act imposes an unimaginable amount of fines and other charges, effectively handing over all of its online regulatory responsibilities to intermediaries. However, the move could have side effects in many ways. Economically great social medias are likely to take steps to delete content if it is questionable, and in legal terms it could strengthen private censorship that infringes on freedom of expression and could result in the transfer of the country s inherent power of law enforcement functions to private companies to exercise their private sector. A number of measures can be proposed to avoid this controversy. First, there is a way to leave the function of assessing whether or not illegal content is individually handled by social media companies to an independent group of experts from outside. It is a way for large companies to invest their money to create autonomous bodies, which include legal experts, government officials, non-governmental civic groups and social media users, to evaluate the contents of the illegal contents in question. Specific assessment criteria, such as anonymization and processing of data for content, will be created by autonomous bodies. The introduction of an authentication system can also be considered as a positive system. The authentication system can be seen as a kind of incentive, which allows online intermediaries, such as social media, to spread it ahead of other content if it is certified as a good content by creating an independent certification authority like the existing authentication system. The plan is to create a system that allows content producers as well as online intermediaries to receive certain preferential treatment in online advertisements if they are certified. It can be a recipe for illegal content to lose power by favoring better content than trying to exclude fake news and other bad content, allowing users to access it more. Contrary to efforts to strengthen the responsibility of intermediaries such as online service providers, some say institutionalizing a near-complete exemption from responsibility could be a way to eradicate illegal content. In the United States, under the Communication Decency Act, Internet service providers are exempt in principle from responsibility for the distribution of illegal content. Exceptions are that online service providers function as providers of information, or the Telecommunications Act, the Digital Millennium Copyright Act, or the Child Protection Act, which excludes the application of the exemption under the Communication Decency Act. When active and free exchange of opinions is achieved without fear of punishment or disadvantage through full immunity, such as Wikipedia s example, it is suggested that the distribution of false information, such as false information, can be corrected through immediate cleanup within the community. Freedom of expression is the most fundamental right in achieving a free and democratic society. These basic rights can function properly when the exchange of views in public chapters is free and active without fear.
