동물복지 개념의 국제통상법상 수용가능성 - 유럽연합(EU)의 사례를 중심으로 -

국문 초록 (Abstract)

EU를 중심으로 한 동물복지정책과 법제도는 국제무역거래에 있어 또 다른 형태의 무역장벽으로 기능할 것인가 EU는, 동물복지는 "... 새로운 유형의 비관세장벽의 도입을 위한 기초를 제공하는 것이 아니다"라는 입장을 분명히 밝히고 있다. 그럼에도 불구하고, EU를 비롯한 선진국과 개발도상국간의 동물복지에 대한 보호조치의 수준에 현격한 차이가 있고, 또한 이 문제는 농산물무역, 위생 및 검역기준 및 환경 등과도 밀접한 관련을 맺고 있는 통상 이슈라는 점에서 새로운 ‘비관세장벽’으로 작용할 가능성도 배제할 수 없다.
‘동물복지가 새로운 비관세장벽에 해당하는가’와 관련한 이 문제는 2009년 10월 15일 가서명된 한-EU FTA와 관련해서도 검토되어야 한다. ‘위생 및 식품위생조치’에 관한 이 협정 제5장은 제9조에서 ‘동물복지에 관한 협력’에 대해 규정하고 있다. 물론 협정은 ‘협력’의 차원에서 동물복지에 대해 규정하고 있지만, 동물복지에 대한 이해와 그 정책적 대안의 모색이 필요한 시점이 되었다고 본다.

다국어 초록 (Multilingual Abstract)

Does the animal welfare policy and legal system taken by the EU work a new type of trade obstacles in international trade On this point of view, the EU takes his position that the animal welfare policy "is not to provide a basis for the introduction of new types of non-tariff barriers". Despite this opposition, the EU's animal welfare policy leaves room for doubts because it is related to a close relationship with agricultural trade, sanitory and phytosanitory, and environmental issues etc.
Then the above question ought to be reviewed to the Korea-EU FTA Agreement. This Agreement contain the provision on the animal welfare in the article 5.9 under the title of 'Co-operation on Animal Welfare'. The Agreement provides the animal welfare in the field of 'co-operation', but it means that our government must try to understand the animal welfare policy and prepare a convenable measures for our country.
