이상동기 범죄 증가에 따른 사회병리현상 논의 : 사회적 약자인 여성피해자 중심으로

국문 초록 (Abstract)

최근 우리사회는 공동체를 불안에 빠뜨리는 범죄가 시간의 경계를 넘어 수시로 발생하고 있다. 특히 불특정 다수를 대상으로 하는 흉악범죄 발생은 심각한 사회불안을 야기하고 있다. 이같은 불안요인 중 특정되지 않은 범죄 피해자가 주로 사회적 약자인 여성임에 주목할 필요가 있다. 현실사회 부적응자와 인간관계에 심각한 결여 등이 있는 사람으로부터 행해지고 있는 묻지마 범죄가 우리사회의 병리현상으로 대두되고 있다. 묻지마 범죄(이상동기 범죄)의 특징은 불특정 다수를 대상으로 목적 없이 저지르는 폭행이다. 즉 도구적 범죄와 달리 묻지마 범죄는 피해자와 상관성이 없을 뿐만 아니라 임의적으로 선택한다는 점과 다수의 가해자는 정신적 병리상태가 동반되는 점에서 심각성이 매우 크다는 것이다. 우리 사회 구성원으로서 여성의 역할이 과거와 달리 다양하게 변화되고 있음에 따라 이들의 인권 보호와 권리증진을 위해서도 여성 대상 범죄예방이 무엇보다 중요하다. 본 연구에서는 불특정 여성을 노린 살인이나 폭력 범죄에 대하여 언론이 범죄의 특성을 무시하고 ’묻지마 범죄‘,’묻지마 칼부림‘,’묻지마 흉기난동‘ 등과 같은 표현이 관행처럼 사용하고 있는 것과 묻지마 범죄에 대한 본질, 불특정 여성을 대상으로 하는 범죄 가해자가 남성이 주류임을 확인하고자 한다. 또한 이 범죄가 사회적 약자 중 개인대응이 무엇보다 무력하지만 경제활동 참여율이 지속적으 로 증가되고 있는 여성에게 발생되고 있는 점을 주목하고자 한다. 따라서 본 연구는 사회적 약자로 구분되어 사회적 보호가 필요한 여성을 상대로 한 묻지마 범죄의 다양한 행태와 범죄의 장소적 특징을 살펴보고 경찰의 대응력 개진과 함께 이상동기 범죄 예방을 위한 방안을 제시하고자 한다.

다국어 초록 (Multilingual Abstract)

Recently, in our society, crimes that cause instability in the community are occurring frequently, crossing the boundaries of time. In particular, violent crimes targeting unspecified people are causing serious social unrest. Among these anxiety factors, it is worth noting that victims of unspecified crimes are mainly women, who are socially disadvantaged. Unsolicited crimes committed by people who are misfits in real society and have serious lack of interpersonal relationships are emerging as a pathological phenomenon in our society. The characteristic of an unsolicited crime (a crime with an abnormal motive) is an assault committed without purpose against an unspecified number of people. In other words, unlike instrumental crimes, involuntary crimes are not only unrelated to the victims, but are also very serious in that they are chosen arbitrarily and many perpetrators are accompanied by mental pathology. As the role of women as members of our society is changing from the past, preventing crimes against women is of utmost importance to protect and promote their human rights. In this study, the media ignores the characteristics of murders and violent crimes targeting unspecified women and uses expressions such as 'don't ask questions', 'don't ask stabbings', 'don't ask questions about violent crimes', etc. to understand the essence of the crimes. We would like to confirm that the perpetrators of crimes against unspecified women are predominantly men. In addition, we would like to note that this crime is committed against women, among the socially underprivileged, who are most helpless in personal response, but whose economic participation rate is continuously increasing. Therefore, this study examines the various patterns and locational characteristics of crimes committed against women who are classified as socially underprivileged and need social protection, and proposes measures to prevent abnormally motivated crimes along with improving police response.
