학대피해아동 보호에서의 아동권리와부모권리의 균형모색 - 영국 아동보호관련법의 전개과정을 중심으로- = Balancing Children's Rights with Parental Rights in the Child Protection Practice -Focused on the Historical Development of the England Law for Child Protection-

다국어 초록 (Multilingual Abstract)

The main theme of this study is on the balance between children’s rights and parental rights in public intervention for child protection. While the number of abused children in Korea has increased, the Child Welfare Act which aims at child protection has been remanded and improved. But the public intervention practice for child protection has often failed by strong resistances of parents abusing their children, so that many professionals and practitioners have called for even more stronger measures against it, in terms of restriction or termination of parental rights. This study also agrees with limiting or terminating parental rights, but it should be limited in inevitable and exceptional cases. This study argues that removing children from their parent and depriving the custodianship of them might induce conflict relationship between parents and their children as like a perpetrator-victim relationship, moreover it can infringe on the children’s rights to care and upbringing from their parent.
This study explored the history of British law about child protection as a finding of research, which has a long experiences of trial and error in looking for the harmony between children’s rights and parental rights. And we can learn from it for improving child care law and practice in Korea.

국문 초록 (Abstract)

본 논문은 학대피해아동을 위한 공적보호에서 아동권리와 부모권리 간의 균형모색에 관한 연구이다. 그간 한국에서 아동학대의 꾸준한 증가와 더불어 그 대책의 골간을 이루는 아동복지법의 관련 조항도 개정·발전되어왔다. 그러나 현실의 실천과정에서는 공적개입이 주 학대행위자인 부모들의 저항에 부딪혀 좌절되기도 하였으며, 이러한 현실의 문제를 배경으로 학계와 전문가들은 친권제한 및 상실을 보다 용이하게 할 수 있는 대책을 요구하여왔다. 본 논문은 불가피한 상황을 제외하고는 친권제한(또는 상실)이 부모자녀관계를 가해자-피해자로 대립시키고, 부모로부터 보호․양육받을 아동권리도 손상시킬 수 있기 때문에, 아동보호과정에서 부모책임을 유지시키면서 아동권리와 친권 간의 적절한 균형과 조화를 이루는 것이 중요하다고 본다. 이 논문은 학대피해아동보호의 긴 역사를 가지고 있는 영국에서 친권제한과 존중을 오랜 기간 반복하며 친권과 아동권리 간의 조화를 위한 시행착오를 경험해온 점에 주목하여, 영국 아동보호관련법의 분석을 통해 시사점을 얻고자 하였다. 즉 우리나라 공적개입도 양자의 조화를 고려하는 관점을 채택할 필요가 있으며, 복지적 관점에서 가족지지를 통한 예방적 아동보호에 큰 관심을 가질 것을 주장하였다.
