행정심판을 통한 건축 불허가 처분 유형에 관한 연구 = A study on the type of refusal of building permits through adjudication of administrative appeals

국문 초록 (Abstract)

현대사회에서 쾌적한 삶을 영위하고자 하는 인간의 욕구는 끊임없이 증가하고 있고, 이런 현상은 도시나 농촌 구분 없이 나타나고 있다. 과거에는 어느 정도 불편함을 이해하거나 특별한 거부감 없이 받아들이던 건축물(용도)이라도 최근에는 주거환경, 교육환경, 생활환경, 토지 지가의 하락 우려 등 각종 이유로 집단민원이 자주 발생하고 있고, 이로 인해 지방자치단체의 허가권자는 ｢건축법｣ 등 관계법령에서 정하고 있지 않은 사유를 들어 건축허가신청에 대하여 불허가 처분하고 있는 사례가 빈번히 발생하고 있다. 이로 인해 해당 건축주로부터 행정심판이 제기되어 행정청의 처분에 대한 구제절차가 많이 진행되고 있음에도 이런 부분에 대한 연구가 부족한 것으로 나타나 행정심판 재결례를 통해 건축허가 신청에 대한 불허가 처분 실태 분석하고 시사점을 제시하고자 한다.

In modern society human desires for comfortable lifestyles have been constantly growing in both urban and rural environments. People used to accept some extent of discomfort of buildings without strong objections; however, people today tend to file collective civil appeals frequently for many reasons, such as concerns on residential environment, educational environment, living conditions, or decline of land values. This trend often leads local governments to reject building permits for any reason they choose, sometimes the reasons that are not even prescribed in the Building Act. Even though a lot of administrative appeals have been raised by building owners and they are in the process of relief about the disposition of authorities, there is still a lack of study on this area. This study presents situational analysis and its implications by reviewing adjudication of administrative appeals on refusal of building permits.
