우리 「헌법」제40조는 “입법권은 국회에 속한다.”하여 모든 법률은 입법기관인 국회에서 제정되어야 하는 것이 원칙이다. 하지만 급변하는 현대사회에서는 국회가 독자적으로 모든 법률의 제정을 담당하기에는 많은 한계점이 나타난다. 이에 따라 우리나라를 포함한 많은 국가에서는 일정 범위 내에서 행정권에 의한 입법을 인정하게 되었고, 이를 행정입법이라고 한다.
현실에서 행정입법에 대한 논점은 행정입법을 국회입법원칙의 예외로 인정할 수 있는지 여부가 아니다. 행정입법이 법률보다 비대화 되어 국가의 수많은 행정작용이 행정입법에 근거하여 이루어지기 때문에 이를 적절하게 통제하여 국민의 권익이 침해되는 것을 방지 또는 제거하는 것이 주된 논점이다.
행정입법에 대한 통제방법은 크게 3가지로 입법적 통제, 행정적 통제, 사법적 통제로 구분할 수 있다. 본 논문에서는 사법적 통제방법에 중점을 두었다. 이유는 입법적 통제는 사전적 통제방법으로 이미 제정되어진 행정입법에 대해서 통제를 할 수 없고, 행정적 통제는 자신들이 제정한 행정입법을 통제 한다는 것에서 나타나는 한계점으로 인하여 국민의 권리구제 측면에서는 비교적 사후적 통제인 사법부에 의한 통제의 중요성이 대두되기 때문이다.
행정입법에 대한 사법적 통제는 각 국가의 특징과 헌법상황에 따라 상이하지만 모든 국가는 사법시스템을 구축하여 행정입법에 대한 적절한 통제를 가하고 있다. 현행법상 행정입법에 대한 사법적 통제는 대법원과 헌법재판소에서 이루어지고 있다. 구체적으로 헌법재판소는 위헌법률심사제도를 통하여 수권법률의 위헌을 결정하면서 동 수권법률에 근거하여 제정된 행정입법을 간접적으로 무효화 할 수 있고, 또한 헌법소원을 통하여 행정입법의 제정형식을 불문하고 그 자체가 국민의 기본권을 침해하는 경우 헌법소원을 통하여 권리구제가 가능하다. 더욱이 헌법재판소에서는 행정입법부작위에 대한 헌법소원도 인정하고 있다. 법원에서는 「헌법」 제107조 제2항의 해석을 일반적으로 구체적 규범통제로 해석하여, 행정입법에 근거한 처분의 위법성을 심사하면서 부수적으로만 행정입법을 심사할 수 있다.
본 논문에서는 주요 외국의 행정입법에 대한 사법적 통제방법을 검토하고, 현행법상 행정입법에 대한 사법적 통제의 현실에서 「헌법」 제107조 제2항의 명령․규칙에 대한 최종적인 심사권이 대법원에 있음에도 불구하고, 대법원이 행정입법에 대한 사법심사에 있어서 소극적인 태도로 인하여 발생하는 여러 가지 쟁점들과 함께 향후 법원이 행정입법을 직접적으로 심사할 수 있는 방법을 모색해 보고자 하였다.

“The legislative function resides with the Assembly,” states Article 40 of the Constitution. Thus, in principle, all laws must be enacted by the Legislative Branch—the Assembly. However, in this rapidly transforming modern era, many limitations arise when the Assembly is to solely assume responsibility for legislation. Therefore, numerous nations, including Korea, have come to recognize the enactment of laws—within certain boundaries—by the Executive Branch: “administrative legislation.”
In reality, the point of contention regarding administrative legislation is not whether or not it can be considered an exception to the Legislative Principle of the National Assembly. The focal point is, as administrative legislation holds greater weight in grounding countless national administrative actions, how to appropriately control this in order to prevent or remove its subtracting from the citizen’s rights.
The means of controlling administrative legislation can largely be categorized into three: legislative control, executive control, and judicial control. This study focuses on the judicial means of control. The reason for this is the following: legislative control, as a preliminary means of control, cannot control those administrative legislations that have already been enacted; executive control, as those who have enacted the laws themselves would control their own laws, face limitations; hence, on the issue of salvaging the rights of citizens, emerges the significance of relatively posterior means of judicial control.
Although judicial control of administrative legislation varies with each nation’s characteristics and constitutional situation, all nations construct judicial systems, and keep administrative legislation under appropriate control. Under the current legislation, judicial control of administrative legislation holds place in the Supreme Court and the Constitutional Court. Specifically, the Constitutional Court may review the authorization act’s constitutionality, and judge it as unconstitutional to indirectly nullify the administrative legislation on the basis of its authorization act. Moreover, if an administrative legislation, regardless of its enactment format, threatens the basic rights of the citizens per se, the Supreme Court can defend the rights in question through Constitutional appeal. Furthermore, the Constitutional Court recognizes constitutional appeal against the nonfeasance of administrative legislation. The Supreme Court, as it generally understands Article 107 Clause 2 of the Constitution as the concrete review of norm, may only incidentally judge an administrative legislation by evaluating its administrative action.
This study reviews major foreign regime’s judicial control of administrative legislation, and the points of contention that result from Korea’s means of judicial control in the status quo. Furthermore, it contemplates means with which the Judicial Branch may minimize the infringement of citizen’s rights resulting from administrative legislation.
