주위토지통행권에 관한 민법 개정안 검토 = Review of the Revision of Korean Civil Code on the Right of Passing over Surrounding Land

국문 초록 (Abstract)

주위토지통행권은 민법의 상린관계규정에 의하여 인정되는 토지소유권으로 인접토지소유자 사이에 통행로로서의 토지사용에 관한 계약이 없어도 법률의 규정에 의하여 발생하는 법정통행권이다. 주위토지통행권은 당사자의 의사와는 상관없이 포위된 토지의 그 자체로부터 법률상 당연히 발생하는 법정통행권이며, 주위토지소유자의 승낙을 얻을 필요가 없다. 이는 결국 주위토지소유자에게 일종의 인용의무를 지우면서 포위된 토지소유자에 대하여 그 권능을 확대하는 것이다.
주위토지통행권은 도시로의 인구집중, 토지가격의 폭등, 도시계획의 지연 등으로 최근 더욱 빈번히 발생하는 문제이며 한정적인 토지를 최대한 효율적으로 이용하려는 상린관계자 간의 이익충돌의 문제로 생긴다. 민법상 상린관계의 규정은 약 30개의 조문에 이른다. 특히 2011년 법무부 민법개정위원회 제2분과위원회는 이들 규정 가운데 우리 사회에서 많이 문제 되고 있는 매연 등에 대한 인용의무(제217조), 주위토지통행권(제219조, 제220조) 및 경계침범 건축(신설 조문으로서 제242조의 2)에 대하여 검토하여 개정안을 제시한 바 있다. 물론 주위토지통행권에 관한 민법 개정논의는 이미 오래전인 2004년, 2011년, 2013년부터 있어왔다. 1999년 구성되어 2004년 활동을 끝낸 법무부 민법개정특별분과위원회와 2009년 구성되어 2014년 활동을 마친 법무부 민법개정위원회는 주위토지통행권에 관한 개정안을 제안한 바 있다. 따라서 본 논문에서는 민법 물권편에 규정된 주위토지통행권의 내용을 간략히 기술하고, 2011년과 2013년에 논의되었던 주위토지통행권 관련 개정안을 비교·분석하여 그 타당성 여부를 검토하고 사견을 제시하였다.

다국어 초록 (Multilingual Abstract)

The right to pass the surrounding land is a land ownership recognized by the neighboring relations of the Civil Act. It is a legal right of passage arising in accordance with the provisions of the law even if there is no contract for the use of land as a passage between adjacent landowners.
The right of passage for the surrounding land is statutory right of passing that naturally arises from the surrounded land itself, regardless of the intention of the party. Therefore, there is no need to obtain the consent of the surrounding landowners. This, in turn, extends the power of the besieged landowners while bearing the duty of endurance to the surrounding landowners. The right of passage for the surrounding land is a problem that has occurred more frequently in recent years due to population concentration in cities, soaring land prices, and delays in urban planning. And it arises as a problem of conflict of interest between adjacent land owner who want to use limited land as efficiently as possible.
The provisions of neighboring relations of under civil act amount to about 30 articles. In 2011, the Civil Law Revision Committee of the Ministry of Justice proposed amendments by reviewing the obligation to cite smoke, etc. (Articles 217 and 220), the right to pass the surrounding land (Articles 219 and 220), and the boundary invasion building (Article 242-2 as a new provision). Therefore, this paper briefly describes the contents of the right to pass the surrounding land stipulated in the Civil Law Real Rights section and examines the validity of the amendments to the right to pass the surrounding land discussed in 2011 and 2013.
