레저스포츠 분야에서의 안전성 확보를 위한 법제 방안 = Legal Strategy for the Sake of Safety in the Field of Leisure Sports

국문 초록 (Abstract)

국민의 삶의 질이 급속도로 향상되고 여가 활용의 중요성이 강조됨에 따라 국민의 스포츠 참여 역시 그에 따라 다양화되고 있는 양상이다. 더욱이 당해 국민의 여가 활용은 레저스포츠라는 참여로 보다 구체화되고 있는 것이 사실이다. 특히 점차적으로 주 5일 근무제가 정착되고 있을 뿐만 아니라 국민들의 소득 역시 증가하고 있음에 따라 향후에는 레저스포츠를 즐기려는 국민의 수는 보다 늘어날 것으로 예상된다. 하지만 레저스포츠 활동으로 말미암은 사고는 재산상 피해는 물론 인명 피해로 직접 연계된다는 점에서 이에 대한 보다 체계적이고 효과적인 관리와 규율이 요구되고 있다. 더욱이 지속적으로 레저스포츠의 종류는 기하급수적으로 증가하고 있기 때문에 보다 기민하고 신속한 대응과 관리가 필히 선행되어야 한다. 이에 따라 미국과 영국 역시 레저스포츠의 안정성을 확보하고 보다 기민하고 체계적인 관리와 규율을 위하여 법제도적인 전략을 도모하고 있다. 특히 지방의 특색과 레저스포츠 자체의 특색을 고려한 법제도적 전략을 구사하고 있으며 나아가 안전사고의 예방과 관리에 심혈을 기울이고 있다. 우리 역시 지속적으로 늘어가는 레저스포츠의 보다 효과적인 관리와 규율을 위해서는 법제도적 전략을 구사하여야 한다. 이를 위하여 체육시설의 설치 이용에 관한 법률 등 개별법적 수준에서 레저스포츠 분야의 규율을 도모할 수 있을 것이지만 현재 레저스포츠 활성화에 관한 법률(안)이 국회에 계류 중이므로 당해 법률을 통한 집중적인 규율체계를 도모할 수 있는 계기가 마련되었다. 특히 당해 법률(안)은 레저스포츠 분야의 관리와 규율을 위한 기본법적 지위를 향유하고 있다는 점에서 그리고 보다 통합적인 관리를 가능하게 할 수 있다는 점에서 그 의의를 찾을 수 있다. 향후에도 레저스포츠 분야에서는 당해 법률을 통한 보다 체계적이고 기민한 관리와 규율을 위한 방안이 보다 구체적으로 추구되어야 할 것이다. 이를 위해서 국회와 정부의 상호 협조와 노력이 전제되어야 함은 물론이다.

다국어 초록 (Multilingual Abstract)

As the quality of life of people is improved and the leisure use become important more and more, people participate in more sort of leisure sports. Furthermore it is true that people tend to make good use of their leisure time by taking part in leisure sports. In particular, the number of people who enjoy in leisure sports is expected to increase in the future on account of the fact that Five Work Days per Week has been established and the annual income of the whole nation is increase. However in a sense that the accident in consequence of leisure sport activities may lead to damage of human life as well as damage of property, it is asked for the systematic and effective management in order to prevent from the accident. Moreover, the swift and efficient management is necessarily introduced on the ground of the fact that the type of leisure sports is increased in geometrical progression. The U.S and Britain aim to establish more quick and systematic control and management with a view to secure safety in leisure sport activity by legal system strategy. In particular they put an emphasis on the legal system strategy by considering the character of local area and focus on the prevention and management of safety accident. Accordingly, we are obliged to adopt the legal system strategy for the purpose of managing and control the increasing leisure sports more effectively. For the sake of specific management, we are able to regulate legal system by dealing with respective legislation such as the Physical Education Equipment Installation Law. Rather than that, we had better aim to regulate the legal system intensively by dealing with the Enabling of Leisure Sports Act(Bill). Because this Bill especially hold a position of Fundamental Act in the filed of leisure sport, we are able to regulate legal system in leisure sport polysynthetically. In future, we are required to regulate and manage the Enabling of Leisure Sports Act(Bill) more systematically and swiftly in leisure sports. Of course, it is reasonable to postulate that National Assembly and the Government should cooperate in order to regulate leisure sport-concerning whole legal system well.
